MLB is cracking down, under Copyright and Trademark laws, all over. One can certainly understand that they don't want anyone everywhere being able to produce merchandise and making profit from unlicensed materials that blatantly look to use the popularity of any given baseball team.

HOWEVER.... Is it taking it too far when they begin to insist that Little League teams buy only Official Licensed Hats/Jerseys/etc... to outfit these youngsters/kids? MLB does not want anyone to be able to use the Name of any member teams and be allowed to have those items done at the local outfitter, while the kids want to show their desire and admiration of the Major League Teams whose names they want to compete under...

Thoughts?

You can't copyright a name like Yankees, Indians and so on unless you use it the same style or it is a unique name.

Now if the little league team has a uniform spot on like a major league team, that is a different story.

Very true, they can attack even similar stylings under Trademarks...

but let me ask you in this manner...

You do indeed view it as Rip-off rather than Flattery?

its not an homage

technically its infringement

think about your own enterprise
dont you have a right to keep your name identified only w/ your product or patent or service ?

its not flattery its a slight form of, tho be it cute, whats the word
D'oh!

plagerism

i mean technically it is
it kinda sucks but yeah if we own a copyright license trademark or patent we are free to invoke that right or divvy it out how and when we see fit

thats the legislation
thats capitalism
bureaucracy

its similar to chinese dvds for sale on a streetcorner
when a movie is just out in theatres -is that ok?

The MLB has the right to charge for the use of their product name/symbol ......... but I don't believe they have the right to impose that type of uniform on any league.

I'm sure that the little league teams could come up with their own ideas and have a lot of fun in the process.

As far as them having professional team members names or logos on their outfits - don't really see the point in it as its about them having their own team and being proud of that. Think it should be separate and apart from them playing ... ie. wear it on their own time

Hopefully the Adults will be creative and allow the kids pay homage...

for example, local Detroit team wanting to be the Tigers be the...
Tiger Cubs
... good play on the name

Trouble there? Since it is 2 different MLB teams?

May all depend on whether they use the Tigers or Cubs fonts for uniforms?!?!?

Yep, made me think that I should've chose a different 2nd option... There is no question, under law, they have the right.... 2nd choice should have been... "They should just be flattered and leave kids alone"

D'oh! correction, that is basically the implication I meant with 1st choice... 2nd should've been... "Baseball is just teaching kids lesson in Law"

Kept waiting... waiting.. waiting... no one chimed in with...

BIG DIFFERENCE between 9 year old kids running around wanting to emulate their heroes (several that are NOT good role models - whole other thread) and someone pirating/duplicating DVDs for profit...
