Question about my problem today...

I have a question about my situation that happened today. Most of you are aware of it.

The police officer suggested that I press charges for assault for me and Emily and I'm going to talk to Brandons father when he gets home to suggest the same in his case.

The officer also said that he was filing a report and or/ filing charges.

So I'm a bit confused about this issue.

My question is... Will she be arrested before we go file our charges just on the police charges?

I may or may not be correct, but I believe they can't arrest her until you file charges against her. comfort

Probably not. The officer has to document the call with a report. If he were going to arrest her he would have done it then. Your pressing charges now is what may get the arrest warrant. For now it's mostly a she says/ she says ordeal. Even if you press charges the arrest may not happen. You will have to stay on top of it and you may have to force the issue.

Sorry dear, I do hope the police do better in your case then I have seen them do here in FL.

Not sure about US Dana, but in AU you have to make a statement and press charges prior to the arrest being carried out.

Not all the time Tina, it is possible for the police to bring charges without public complaint.

He came by looking for her a while ago. She had left before the police got here. And I think he said he waspressing charges. There were 4 of us there as witness to what happened and she'd assaulted 3 of us.

I think they will. She's been in trouble with the law before and the cop was pretty ticked about it.

Yeah, I think so. I just wondered if they were going to arrest her. I know they drove by looking for her, so I assumed that was why. She lives next door to me.

You really need to just file the charges asap, (your choice though) as far as laws,,,check with the city,,county or state,,I know that everyone likes to help but it is too random and you must know this for sure. I agree with whoever said to hold them accountable, weather or not there is a claim,,,(civil) or Criminal ,,,I would stop them every way they never dreamed,,,legelly of course, but I would not wait a second, I would make it known that you will not be treated this way and that there is consequences and you are not one to hesitate.

Thank you. He said I have a year, but we'll go in the next day or two. I've been hurting too much today to want to go stand around down there to file it.

Brandons dad is home, so I'm going in a few minutes to talk to him about filing charges for Brandon.

Hey Dana, just keep ice on your neck for now & think about this...

The charges the state bring against her are different than the personal charges you file.
Each helps the other in court, by theory. This lil punk ass needs to get her reality check before it's too late.
Money bets says she already has had run in with the law. She may be one of the ones they have been waiting to get off the streets & your complaint is strong... just what they need to get it done.

Try not to wait to file charges. The sooner you do, the better the judge looks upon it.
Get yourself completely examined by the doc & try to take it easy. These things take forever sometimes but at least you are going after her so she wont do this to another family.

Since the police said they were filing charges they can arrest her themselves as they could see you had physical evidence that she had assulted you and your child.
