if you are not hospitalized.. you need to press charges immediately.

also.. the cops can arrest her and hold her for 48 hours in most states without charges. then if charges are pressed she will go to court,
You will also have to testify in court when she gos to trial. unless she pleas guilty.

she should already be in jail,

DO NOT wait to press charges yourself!

As we in the hills know how this will go.They will let it go with a warning. But they will ask if you want to press charges. And since she did attack you, what is to stop her from attacking maybe your daughter. Also post a no trespassing so if she steps in your yard one phone call will take care of her minus your bruises.hug

Not all the time Tina, it is possible for the police to bring charges without public complaint.

This is true in some states...If there's evidence,( obvious injuries), such as the red place on your neck and the scratches on your child...The police can charge her with out your complaint...especially on a minor...
Good luck in this matter....and take care of yourself...

Hey Dana, I just got home and read your thread. Hope you and Emily are ok, and do go first thing tomorrow and press charges. And take pics of your injuries too, in case you need it in court. The police should tell you this stuff, but I guess they just assume everyone knows, they deal with it so much. Since there were 4 wtinesses to what happened, and the cops know her already, she just might not get away with it this time. kiss Here's a kiss to make it feel better, and one for Emily too. kiss

I have a question about my situation that happened today. Most of you are aware of it.

The police officer suggested that I press charges for assault for me and Emily and I'm going to talk to Brandons father when he gets home to suggest the same in his case.

The officer also said that he was filing a report and or/ filing charges.

So I'm a bit confused about this issue.

My question is... Will she be arrested before we go file our charges just on the police charges? Thanks everybody!!

Hey D,

It seems as though you hae to press charges to have the rest happen.
It seems that way here in Cali. Just go fo it. Someone should pay for your misfortune and you having to live as you are.(with pain).
