Justice Gone Awry

Just looking at documentaries and found one that is particularly disturbing...a 12 year old sentenced to prison for 25 years...tried as an adult!...yes...it was for murder but this young boy is not a threat to society in my opinion...just made a very bad decision to help his friend in murder...

The other boy involved was 15 and decided to kill his step dad and asked for his younger friends' help...not premeditated as it was discussed only a few minutes before the murder occurred...so why did both receive such harsh treatment?...tried as adults and given 25 years in prison and will be thrown into the adult prison population when they reach the tender age of 18...

Although people need to feel safe...perhaps the judicial system is far too harsh...after all they are not adults...just foolish kids...they still can learn from their mistakes and become productive members of society...

Terrible things happen but young people do not always do the right thing...hard to forgive and forget...the step father wasn't a saint but did not deserve to be killed...

These boys were not bad kids...it just shows you that kids need guidance from their parents...under developed brains that cannot navigate around problems effectively...or properly...would have been better if the kids could talk to a parent about their troubles instead of acting out...but now they regret it...they truly are sorry...

The problem is how can a system be fair to both sides...looking at Norways' penal system...an interesting way of rehabilitating criminals...

Lou, I don't think children should ever be tried as adults.
They aren't adults end of.
That does not say that they should be released early if they committed a serious crime. They should still be monitored closely by professionals.

Young brains are not fully developed and there is a reason why they are not allowed to vote, drive or drink.
They can't be treated as a child for everything else, and an adult on a whim.
How many times have doc books described murders who started young, maybe by pulling wings off flies, to then killing animals,

I am sorry loulou even a small child instinctively knows killing whatever is wriong it is a feeling inherint in all humans. So kids helping or doing is a precurser in the main that is that he she will kill when older.
Maybe not adult prison but lock up conditions for sure. I do know kids are kids and their minds are growing BUT killing is not a growing kids normal mind.

Does a 25 year sentence mean 25 years will actually be served?
If he demonstrates rehabilitation, is there possibility of parole? When?

She's been imprisoned & living in the shadow of the noose for seven years now.
More than likely, the main reason she's not yet been hanged is continuing international awareness of her plight & pressure put upon the government.

This is an issue in which people can become actively involved.
Those supporting measures to spare her life/release her may simply sesrch...

That will bring up the site of group(s) advocating for postponement of her execution, and eventual release...something for which we can hope & pray.

Involvement/international pressure now could prove decisive.
What may be her final hearing before the Supreme Court is upcoming this June.

Thanks for commenting...although the two boys did comit murder...I think the whole point is that they were tried as adults...and I believe that they need psychological counselling to find out what makes them tick sort to speak...to rule out the possibility of being psychopaths...
How do Lou, haven't read any comments here nor have I watched the video either.....
the young brain/mind of the child developing ( I understand that) so I've a good idea what the clip is all about.

If the boy in the clip were my son, I'd beg everyone to watch and try understand with the hope for being excused..
but if the man he killed were a loved one of mine, I'd beg for the opposite.

one thing you mentioned that caught my attention " threat to society" .......
is that how sentencing is measured up?

What a price to pay when you are young and stupid...the thought of adult prison would scare anyone...and yes how long will they serve?...but there were more mistakes made in the case of the two boys...the parents were rather naive in the whole process...

I think in this case the parents were naive of the system...the boys signed waiver of appeals...and somehow got them tried as adults...but fortunately the 12 year old's case was reviewed...not in adult prison...and on condition of his progress in juvenile detention will determine how long he will be incarcerated...

It is obvious that the 12 year old was not a problem child...he became a mentor for many boys held in juvenile detention...a role model...

That is the good news...as for the other older boy...good that his dad visits and forgives him...his mother has yet to visit...

The step dad was a drinker and the boy thought he was abusing his mother...not an excuse to murder but it seems that he was troubled...but no one stepped in...sad really...he is now in the adult prison area...

I think the family of his step dad are stuck with mixed feelings...want justice for their family member but recognize that he was troubled...

A 25 year sentence (a person's life was taken, after all)...
With the possibility of parole at some point...
To be served in the juvenile system 'til age 18...
And the adult system thereafter...
actually sounds fairly reasonable.

The U.S. is the most incarcerated society on Earth.
It has about 1/20 of the planet's population...and 1/4 of its PRISON population.

Some have claimed that the U.S. deals with housing & employing certain groups of people by imprisoning them.
Maybe.
No matter how one may attempt to explain the numbers quoted above, they are a gross national embarrassment & disgrace.

Back to my blog topic...there are people out there that want to look tough on crime but serves an injustice to many...look at the second video clip...the fallout and tragedy that occured because they the prosecution and the police department including the social worker decided to put words in the childrens' mouth and made them feel that they had no choice but to lie...sometimes people act badly...and it is up to society to ensure appropriate measures or checks are in place regarding the judicial process...

The parents were shocked that their 12 year old was responsible for shooting that man...and they said he does need to be punished and if there is a psychological problem...they wanted him to get counselling and treatment...unfortunately the prison system does not provide many programs unlike juvenile detention...
