A few weeks ago I ate at Taco Bell (kinda late at night) and developed a foodborne illness due to their food. I had to be taken by ambulance to the hospital and they kept me for 2 days. I also developed Diabetic Ketoacidosis because of loss of so many fluids. I have been in touch with Taco Bell's insurance company and told them that I feel they should pay for my medical bills and pain and suffering. I was sick for about 2 weeks. I could have died from the DKA and feel that they are responsible for letting the food sit out too long.

The insurance agent asked me what I wanted for pain and suffering and I told him I would have to do some research before giving him an answer. From what I could find, foodborne illness cases receive anywhere from $25,000 to 3,000,000. I feel that since they essentially put my life on the line, I was going to ask for $200,000, knowing that they will jew me down.

I could really use some insight on this because I truly don't want to take it to court, but also don't want to get short changed since my whole life was put on hold because of their carelessness.

Sue their pants off!!! They got millions, they are lucky you haven't taken this to the networks.

I just didn't want the loooooong drawn out drama of a lawsuit. That's why I was going to try to settle with the insurance company. I don't know if I should start higher or not. I also need to decide what the least is I will accept....if they don't want to settle, then by all means, I'm going to sue them!!

What "I would do" is ask for medical bills, lost wages, plus a mere $1,000.00

I know $1,000.00 is nothing as far as compensation for what you could have gone through however I would now put it in my past, buy myself and my daughter something nice, and move on.

I'd go no lower than a quarter of a mil, honestly...its not like Joe's shack...Its taco bell!!

Find out what they payed out to their last victim with the same type of medical problem and ask for that exact amount.

By paying that to someone already they have established a precedent for what they feel the damage is worth.

Thanks for your input. I'm a full time student and single mom trying to get my life together. I feel that they need to be held responsible and punished for what they caused, so hopefully they will be more careful. I wouldn't want to see my worst enemy go through what I went through....I truly thought my time had come....it was awful.

Hope you are feeling better. Is the DKA something that is going to be with you for the rest of your life? If so, is it or can it cause any complications or change of lifestyle. These are just a few things you need to consider before settling. I would talk to whatever medical people necessary to assist you with these questions and go from there. Do not be in a rush to settle. Good luck

Don't hesitate girl! I've had multiple heart surgeries because of a drug, & other comps and now on my 3rd and no end in site...I SHOULD have done something because my med bills are drowning me.
