The wheels are in motion I have finally contacted the lawyer and started the divorce proceedings .
I do however have to talk to my ex to get her address so she can be served the papers .
Of course ive asked the kids to txt her to call me !! And of course in her work (she now works like wtf ) she is in Darwin until next weekend doh

Thanks Jem its a bit weird she hasnt wanted me to know where she lives .But she can come here and see our adult kids !!
My lawyer said if she doesnt feel safe for her to name a place that the papers can be served !!

Micky, lawyers will charge you heaps "searching" for her. So watch out for that one. The only real need you have for one is to get the process server to hand it over. I did my own paperwork and lodged it at the court (Family Court is cheaper). In fact, just about anyone can do it. My ex-brother-in-law handed over the papers himself with me along as the witness, had to make a small statement attesting to me witnessing it. My daughter arranged through her law firm for a process worker to hand it over for me (they don't need a witness).

So next time she is visiting your kids, you can take a mate along and do it yourself, or get a process worker to do it. But word to the wise, let the kids know you want to serve the divorce papers and tell them why it has to be done this way. Hopefully they will understand.

Keep the lawyer stuff down to only what is necessary. Much cheaper to go to a counsellor to let out your worries.

if the lawyer finds that he can't locate her, then he would need to apply for an order from family court seeking an order that you must advertise in all the major news papers your intention to divorce her, think that's still the process = money lots of it to

So wrong Rob. It would only work if you had nothing and aimed to have nothing in the future.

Had a mate whose wife left him with the kids and they never got around to divorcing. 20 something years later, she filed for divorce, and then went for half of all the property and super he had. The Court made her the winner. But things have sort of changed since then but it all depends on the lawyers and the one sitting on the bench, not what is fair and reaonable.

i was referring only to a divorce, not matrimonial property settlement. Looked into getting a divorce, to start that process required $500 family application court fee (even if your a pensioner) then you need to apply for dispensation to wave service on the other party, that requires that you advertise in all major news papers over couple months...money and lots of it.
If Micky is talking about property settlement that is different however pretty sure he said divorce, two different matters

Lawyer is a friend of my mun so she is doing it cheaply .Still the court fee is $500. My lawyer is going to serve the papers .
Property settlement has already happened she got half the house .Well she demanded we sell the house and she wanted her half asap .Her problem being location and the fact she left the place like am aprentice hoarder lived there .Result we lost heaps getting the place cleaned out and lost heaps due to location .
Anyway I got tired of hearing why arent you divorced from shiela's your not over your EX!!

That's odd it didn't cost me a cent to get divorced in Victoria a few years back, i'm on a Veterans Affairs pension, it was pretty straight forward although i must admit, my ex and i still get on pretty well so that helps.thumbs up

As I said I was getting tired of shielas I dont know telling me I'm stuck on my ex .Due to not getting divorced .
I am also worried about what I heard on the radio not so long agao.Where a couple similar to me and my ex .Split up got divorced didnt have anything to divide .
Few years latter both remarried he wins lotto she takes him to court and she gets 100s of thousands of his millions !
Dont want that to happen to me !! I'm paying for it to be correct and the only thing we havent divided up is my super not sure if she has thought about it seeing she put a stop to me paying into a super fund confused
So thats it in a nutshell!!

I think Micky that she is entitled to claim a percentage of your super for the time you were together, but again not sure,that that can only be paid out when you retire or your super fund is cashed in.

If you have already had property settlement I suppose it will depend on if she gets a lawyer and if the lawyer goes after your super. Next time you see your lawyer ask or let your fingers to the searching and check online.

I think we both know the answer she is entitled to half so she stopped me having it .while i was with her it was about 20grand .Lets not forget when i started work you had to be invited to join a company super !!
Ill wait and see if she is awake .mind you if she is being flown around Australia ie from SA to NT by the indigneous community she must be earning a heap herself

If your property settlement has already been through the courts (hopefully that is what you mean) then the divorce itself is realtively simple.

Ex #1 did the property settlement before the divorce. She got 85% of everything because my lawyer didn't really understand Family Law. When it came down to the divorce itself, the Court wanted to know about any arrangements that had taken place beforehand.

Ex #2 was a different matter. I did the divorce after 12 months separation so it would be legit. Okay, that went through oh so many problems. Just took another 4 years before she would let me have the home that I paid for lock stock and barrel from selling my other place. She never contributed to "our home," too busy paying off her one. And finally gave her mucho pokie money to let me keep what I had paid for.

As you have already done your property settlement and the kids are adults, the rest should be simple. Beware of the clawsssss of the legal eagles.

Property didnt go through the courts we agreed a 50 50 split .
Or will I get told off for that by the court !!
Or will they take that away from me
