just need to let off some steam

came here december 2011 when I was offered the most awesome Job.
After putting in for my Visa I started straight away... only to end up with

working 75 hours a week,
from March 2012 till december 2012 I only had 1 day off a month!!!
since January 2013 I have one day off a week, but still work 65 hours.

My pay was, if it was paid, less and less been told its a TAX thing and of the supa i have to pay.

Now i found out that there has never ever been one payment made into my taxaccount, and my supa should have paid by my employer and not been taken out of my wages.

when I realised so many things what i had to put up with are almost criminal, and told my employer what he is doing to do things right... i was given my notice.

I love Australia, but seriously I feel sick to the stomache to think what the next few weeks will bring, if I find a new Job or if I end up been deported...

that wasnt at all what i expected :-(

Oh that's awful, look your not alone, there are labor laws employers have to follow and yes that could cause you problems as the Australian government can't be trusted and you'd be sticking your neck out in approaching them

On the other hand if i recall correctly you've sold everything you owned in Germany, and moved to Australia believing what you were doing was legal and what you do now will impact on your immigration record...
you do get yourself into some interesting situations, have you followed Mr Dotcom in NZ?

sorry cant find the info I am looking for but I know you need to make sure you get your PAYG summary, or sometimes called your group certificate.

Threaten legal action etc if they refuse and they do not have to wait until June 30 2014 to generate it if they are not going to re-employ your.

Contact the Australian Tax Office as soon as you can and set the wheels in motion.

I hope you can get some help from the ATOhug

Robp what has happened here is fraud and if nothing is done, no buttons pushed, the employer will get away with it and possibly do what one of my former employers did, declare bankruptcy and then phoenix into a new company doing exactly the same things to other people.

I was lucky, I only worked for them for 6 weeks so I didnt lose much, others werent as lucky

as far as I know I have done nothing wrong, I have it in black and white from my employer that HE will pay my Tax and Supa, only when he refused the group certificate it all came out.

I knew that things went downhill month back, in a very bad way because up untill now i never ever been given a payslip and when I keepd asking for them ( wich was a lot of times as i get paid weekly) I was always told .
" Here in Australia you dont get payslips. and if you dont shut up i put you on a f...ing boat back home

I get pay slips,
you will find there is not much you can do about it without spending money to fight it,
people here often do not notice but our governments have slowly stripped away our rights in the work place, even the unions have to spend money in the courts for proper rights,
unless you are in a public service union then more often then not they give in,
private sector,,were all a bit f....ed over,

Whats occurred is illegal, you've been taken for a ride. My first thought was to contact a Federal Opposition MP, someone like Craig Thomson MP to see if you can get some directions

See if its possible to attend his office and have a frank discussion with him. I know there are allegations and court cases hanging over Craig, but he is pretty well informed from Union experience and might lend a hand...

Have my thinking cap on but thus far move like that might gain you some positive support from some department

As the Employer filled out a Form from the Goverment stating how much he will pay me, and that he has to treat me like an Australien for the period my Visa is valid for he sighned an agrement with the Goverment to play by there rules.

Fair work Australia already said they will provide me with a Laywer without having to pay out of my pocket.

You see, I know what i can do but that doesnt help me at the Job front, because it doesnt matter how much backpay i would get, I simply dont want to go back to Germany.

Had the ATO take maintenance payment out of my wage, then @ tax got launderd for 3G!Boss ripped me & no come back? Power paid ex maintenance by 2.5g, no payback! ATO are thieves! Just want a fair playing ground!frustrated

yeah the ATO unlawfully took my tax file number off me, which took away lot of business interest, you can put trust in Aust Government, only got to take a look at the extent of public purse in the rudd family assests

Stuff your luck Alle , its not an Aussie thing , filthy employers are pulling similar stunts on emigrants here . Every now and then prosecutions happen .Not against the company but the person breaking the law .

Don't give up . Keep pushing . The best thing I can say is don't put emotional capital into the battle . Just your time and thought .Let the other party loose sleep over what's coming .It's hard to do to remove yourself from the problem to deal with it but you need to . Try to anticipate what the other party will do so when they try something it won't surprise you . Never think they will be honest or want to clear up the problem .
I hope you understand what I have said . Keep us informed .
