Some interesting cases on provocation as a defence...If people want to read 100's of pages. Irish law is covered well but I didn't see its use as a defencein domestic violence cases which is a big partof it now.



The next paper includes provocation and many other things as used in mitigation during the sentencing part of the trial.



My interpretation might be right, somewhat right, a little right, or completely wrong. laugh

Some interesting material, but where does it say that looking at someone's girlfriend can be introduced by the defence as justifiable provocation, and where are the examples of a judge ruling that looking at someone's girlfriend is acceptable as mitigation? dunno

Sentencing - chapter 5. Provocation as mitigation. It won't list the exact circumstance. It is a subjective test. Provocation won't be a defence for any outside homicide. It can be a mitigation for any case though.

But that still doesn't state that looking at someone's girlfriend is provocation, and neither is there any evidence of a judge allowing looking at someone's girlfriend to be used as mitigation. dunno

Do you consider looking at someone's girlfriend mitigation for a physical assault? confused
