Accordingly an attempt is made to avoid Justice appointments that reflect political bias. The Republicans have been especially vigilant ( in the past) in their declarations of impropriety in appointing a justice just before a presidential election.
While an appointment can occur now, it opens a pandora's box of other actions a new Congress might impose in its own political interest in the future.
