One who is not able to just be, and requires some semblance of control through an imagined or preferred bias.
Often it doesn't take much time to be able to judge somebody...and be right about them. The situation may not show the whole spectrum of the character but yet one shade of it may be more than enough.

Law and order. These are a generalisation, a necessary evil, without which there'd be chaos.
And then the enlightenment came along with it's justice with it's disorderly idea that judgement needs to be correct within reasonable doubt. Which is not an idea that is catching as we move towards the Chinese way. Popular verdicts and the national interest are "correct", nobody really cares what really happened.

I'm not entirely sure what point you're trying to make. The two clearly mean the same, but discrimination is more often than not seen (falsely) to have negative connotations.

So my point may be that discernment is a weighing of the pros and cons of a situation whereas discrimination maybe the result of a judgement without just cause. Discernment could never happen without just cause, whereas discrimination could. That's my point.
