K, I recently sold my 87 Blazer to this guy. He was in his early 20's or so? Anyway, his dad called me tonight asking me to take the vehicle back. He said it needed alot of work and his son didn't want it anymore. First, I told the guy I sold it to what all was wrong with it. Second, I wrote on the bill of sale "As is" under the special conditions section. Third- I sold it to this kid for $400.00 cash. Now, I have told his dad that I am refusing to give him back his money and I told him the sale was final. Now he's threatening to take me to small claims court. I'm thinking he doesn't have a case considering I stated on the bill of sale "As is"? What do you think?

No worries man. As is is As is. Besides what do they expect for $400? I wouldn't be worried about it. As long as you crossed your T's and dotted the I's.

Caveat Emptor(Buyer Beware) .....he doesnt have a leg to stand on......AS IS means exactly that.....you have nothing to worry about unless this guy's dad is a lawyer and wants to be difficult......hopefully that will be the end of it for you Dougiewave What did he expect for $400 as is vehicle??confused

Well, apparently this kid is mentally challenged? Apparently he's on disability and on AISH? Well, this kid was out at the bar the night before with a buddy of mine and that's how he found out I had the car for sale. I figure if he was out at the bar then he can't be that mentally challenged? For the record, I did not know about his mental condition until tonight when I spoke with his dad. Still though, I always figured "As is" is exactly that, "AS IS"? I just bought a van last week and on Saturday the alternator crapped out. It cost me $280.00 to fix it but, I can't go back to the guy who sold it to me and demand my money back!

Well Dougie..in my province its called a Form 21....meaning someone is legally deemed incompetent to manage their finances and they either have a designated Committe to oversee their money or the office of the Public Trustee overseas it...if neither is the case......the man's father should look into formalizing his incompetence then...hope that makes sense...wave

Actually, I don't really get that? Still, if the kid is mentally challenged to a point where he can't buy a car, then why in the hell does he have his drivers licence? He can't be that mentally challenged if he's legally allowed to drive!

Am just saying...that unless there is official paperwork deeming him incompetent to manage his financial affairs....he can do as he pleases with his money....and I am thinking if he is competent to drive.....there cannot possibly be papers filed to deem him incompetent....I hope that makes sensewave

Thanks! I figured if he's driving then he can't be that mentally challenged? Regardless, it's not my job to screen people if I'm selling a used car!

Just for the record as well cause I don't want people thinking I burned this kid, I did tell him all the things that were wrong with this car and I also said to him, "It is what it is, a $400.00 vehicle". Just don't want anyone getting the wrong impression! Also, if you met this kid you would never know he's mentally challenged. Like I said, he's driving legally and he goes to the bars just about every weekend! I don't know of any mentally challenged people who do that?
