In the United States (unlike the Soviet Union or Russia) the Supreme Court Justices are supposed to base their opinions on the Constitution of the United States. Accordingly an attempt is made to avoid Justice appointments that reflect political bias. The Republicans have been especially vigilant ( in the past) in their declarations of impropriety in appointing a justice just before a presidential election.
While an appointment can occur now, it opens a pandora's box of other actions a new Congress might impose in its own political interest in the future. Of course a Russian troll or a Chinese etc. will say so what!
