Dog owners are responsible at all times for their animal. If your dog had done any damage to the car YOU would have been responsible not the driver. It was not his fault your dog ran off. Did your dog manage to survive with severe spinal damage?
Accidents will happen. It is a horrible feeling if you hit an animal but I'd prefer that to slamming into a wall trying to avoid it or causing a pile up from the rear.
