jlw45: i think, you and a whole lot of other people, have it just alittle basackwards
Would you keep on endorsing McCain or nobody? How about Comunism-socialism for a change? The country is of everybody, the land teoreticaly belongs to everybody but in practice the state does whatever it wants? At least everybody would eat the same and health system would benefit everybody, on top of it, America and Cuba would finally go along and no more wars around the world because capitalism woould be the driving force anymore

cristina: If the economy was already on a down hill slide, would it be great if his sucessors worried a bit more about it? Do you think that Bush went after peace or after oil in the Middle East? Did he bring you some peace to your pocket or neighbourhood?

If the land belongs to everybody, then it doesn't belong to anybody as I see it.
Property rights are diminishing for a variety of reasons, high property taxes, environmental concerns, eminant domain, etc.

Certainly the "state" should never own it.
If Property Rights diminish, that's communism getting in slowly. If you mean Property ownership, then that is happening everywhere, don't worry too much

yea, i'm not worried....i can't wait to stand in bread lines while the elite have caviar...........
And come on guys we have your state rights and our federal rights. It is written like that for a reason.Eminent domain was granted by our federal government for each state. And the state can step in and take land if they so choose. But lets think back didn't we do the same to the Indians just take and move them to the side. The government is set up like in cycles.First wash you get is usually county, leading up to state and then to federal.Eminent domain isn't always given or granted. You have rights so use them.

Step in and take land if they so choose?
Are you talking abou expropriation? It's not that arbitrary
There is act that Congress passed and applies in some eminent domains. Its called the homestead act.And what it means is you live in a residence and you claim it as your homestead it cannot be taken. The court will not bother to tell you this. But I promise you this let someone try take your home and you inform the court ask it be recorded, that it is your homestead. It cannot be taken. Most of our states honor this, heres hoping you live in one.Its a shortcut to property rights. And you will not be advised of it,you got to bring it out.

Even in this day and age eminent domain exists. In the 50's there was so much land devoping going on.So many easements being granted. As back back as the reservations I will say thats when eminent domain was established.Correct me if I am wrong. It still belongs to each state the decision to use it.

eminent domain must be what most call "public interested" whereby private properties may be taken if it is for major public interest utility but always with indemnity involved of course. So you mean that homestead voids any possibility of taken? Gotta read about it tomorrow. It's quite risk if it is just like that. This must be limited to certain kinds of properties, that might be in advance, free of any interest, including the area of location...even so, it's risk to not leave a door for expropriation because you never know what may happen.
