I bought a mobile phone on the Vodafone online store just before Christmas.

About a week or two after receiving the phone, I noticed during a call the phone would disconnect automatically, at first I thought I might have had pressed a button by accident, or maybe I was out of coverage. Now it's not even switching on.

On Vodafone's website under their returns policy it states:

"If your phone or accessory becomes faulty within the first 28 days, you are entitled to a replacement or a refund."

When I first notified Vodafone of the issue by email, I was just within the 28 days on that very day.

I spoke with a senior manager of Vodafone who informed me that I was not entitled to a replacement phone or refund. He said that Vodafone's policy was that they would need to have received the phone back to the online store within the 28 days to qualify for a replacement or refund. I asked him how he expected me to get the phone back to them on the same day that I reported the fault. He said that was up to me to get it back to the online store.

In that case, my phone would need to have stopped working on about the 26th day, so that I would have had enough time to send it back to Vodafone, as it would take a day or two to reach the online store by post.

I'm just wondering if anyone else has had any similar experiences ?

As far as im aware you are still within your consumer rights as you reported it threw email before the time was up,, if it took another week to arrive after that then it is not your fault, you have your rights, and any item purchased from a retailer carries a warrenty of twelve months from date of purchase to be either fixed or replaced if cant be fixed, send it back as your within your rights too.
And make print out of purchase and keep copies,, check out consumers rights and you will be suprised at what entitlments your covered for.

Did you purchase it online or in a shop?

You have a lot of rights. What they have said to you is wrong.





The above will give you some guidance. But with most electronic goods you have two years consumer protection against a faulty product. Stand your ground.

That's right Sukatai, I did report the fault before the 28 days was up.

Vodafone did offer to repair the phone, but if I am entitled to a replacement phone then of course I would prefer that.

I will check the consumer rights website or maybe it would be better to phone them tomorrow just to be sure.

Yes, I did purchase the phone on Vodafone online store.

I posted my issue on Vodafone's website forum earlier on and one of the Moderators replied that he can see my point.

He said he will look into the policy on this tomorrow and then arrange to give me a call after afterwards.

So hopefully it will be sorted soon!
