In my state, as I understand it (and I may be wrong), you may use such force that is necessary and proportionate to level of threat. In other words, if you can demonstrate that you used the minimum force required to stop the assault you will be exonerated.
However, if you are trained in martial arts, and the suspect dies ... then you are considered to have assaulted with a deadly weapon, and might have a task on your hands to prove that deadly force was the only option available to you.

Believe it or not..many would say the victim is the cruel one, which is dumb.Look at the Zimmerman case in FL. Many assumed after reading the NEWS ALONE that he was wrong in killing someone who banged his head down. Yet,admittedly he COULD have lied,of course, and maybe there was only somewhat of a struggle and he ended up with an accidental wound on his head that wasn't intentionally directed at the head in that way. I asked the question without mentioning names,purposely,also.If I knew someone was trying to harm me in areas like my head..I would try to hurt them with great pain first, if I thought there was time - otherwise I would try to stop them in any way I could.
