I've known people who, disillusioned with the "'til death do us part" thing have realised that their vows were meaningless, (for example if their spouse cheated on them). As divorce can be a costly and stressful, sometimes people may not bother making a fuss over legally cancelling vows that have been cancelled emotionally a long time ago. There are others who maybe in process of divorce, but this can take some time. Would you, or anyone else view these people as still married and so off limits, assuming they had told you the truth about their situation?

I think married is married - get a divorce, costly or not. I don't know about America but there are organisations here (like your Public Defenders I suppose) who can get a divorce through the courts much cheaper than private lawyers. You may not get all you want but so what. Let him keep the tables and the pots. I would just want out - legally.

That's crazy. Has anyone ever questioned that law? Why do they have it?
amahlala: If they've not put married or separated on their profile and you discover after you have both exchanged mail that they are still married, then I would suggest that you politely tell them that you are not interested in playing games and wish them a wonderful life and get on with your life.

In Italy it usually takes three years for a divorce to go through. Can you imagine to be chained to someone, you've fallen out of love with a long time ago, for such an extended period of time?
Also, in theory it's always easy to have very strict principles such as never to date a married person, but I've learnt from experience that life is rarely straighforward, and people can find themselves in all sorts of strange situations for a number of weird reasons.
I'd listen to the other persons' stories very carefully and judge afterwards, they might have had very valid reasons for doing what they were doing.
