You're not very specific in your polls ARE you sir? First off...what case? what caused it and how is the claimant or defendant any different depending upon the case at hand? And why is it that so many see the finances angle above or beyond the legalities? You DO realize they both exist and are capable of morphing into several litigation's stemming from the origin of the original...double jeopardy treads and trails this grey area in law...

That is up to the judge,....they are called court costs, and in SOME cases, must be dealt with....it depends on the judicial system of the country involved and the judge who is seated.

True. In Spain that's the rule only for those who loses completely, not for those who wins/loses partially.
