The lady that was assigned to my case really knows her stuff. All the delaying came from the other side... refusal to agree with anything roll eyes

I hadn't any property issues (as in signing over of house) so it was all plain sailing.

Excellent value, excellent representation all for less than the price of the weeks shopping.

Hi D wave

Every case is different as we both know. But if there is just the two parties involved, (no children) it then comes down to equity and the legal teams on both sides has a field day. They draw it out for as long as possible if the parties can not reach an ammicable agreement. And if it goes to the court, then its big money.................. sad flower

Oh Hi N.....

What you are saying is true D and there is not a thing we can do about it. The waiting for a court hearing can be anything from a year to 18 months from the date of application.

Hiya

I got my divorce last January, took 8 weeks from date of application to court date and cost me €500.

Took 5 minutes in court and was done and dusted.

Went the DIY route, mo soliciters involved other than to get a signature which was €20 a go and that was included in the €500.

I never had a legal seperation and years ago got maintenance for the kids sorted, has been €20 per child for years. He has no interest in seeing the kids so no need to sort out access. And no property as he gambled away our house years ago and the one I am in now is mine.

So was an easy process for me.

i have a close friend who has been seperated for the last year and a half, they had been married for 4 years and they have a 4yrs old boy, she was involved in a religious group and she put that before her marraige and child and finally she left the family home with the child and rented a house in another county were she is now seen a guy from that religious group thats why she left in the first place as she wanted to be with someone that could love god and be part of this group with her thats all she ever wanted and there marraige was a huge mistake,

my friends dad died and left him the family home and there 20 acre farm but it is in his mothers name for her life time then it comes to him when she passes on,he dont own it its not his asset and he makes nothing from it and his mother is young and healty and it could be another 20 or 30 years before it becomes his land,

they built there own house on a free site that his mother gave him, mortgage 320k value of house now 260k they have no other assets wat so ever he has offered to take the mortgage over from her and relieve her from it to settle this but she wont do it she is taking it to the circuit court for wat nobody knows as there is nothing else there as in assets,so basically he is relieving her from 160k of a debt which is mad but he wants to keep his house as its on the farm, this is a house that is in 60k negative equity and his solicitor is telling him the only way out for her is to sign the house over to him and she walks free from the mortgage but she will not do it she wants circuit court,

has anyone been in a situation like this or can anyone shed any light on wat might happen here for him even at the moment he is not working as he lost his job were he was in construction,

If there is no contest regarding custody or property then you can get off lightly

You can even get the documents yourselves and fill them out, submit them to the court for stamping and it will cost you less that thirty euro.

I'm glad to hear someone priase the Free Legal Advice Centres. They normally have a lot of bad reports attending to their cases. You can only apply for free legal advice in respect of divorce if your assets are below a certain level. I think it is about a quarter of a million euro but you would have to check with them. If your assets are over that they will still represent you but will get you to sign a yellow form that allows them to deduct their total costs from any property recovered, i.e. your home or part therof. You may find yourself having to go to their office a lot as they mount up the bill.

If you cannot agree a settlement with your spouse and go the DIY route then you might want to look into 'Rate my Solicitor' before retaining the services of a lawyer.

Good luck with it anyway. It is always a painful time. Nobody gets married with divorce in mind: except the guy who married Liz Taylor or the woman who married Paul McCartney!

Hi Dude Thanks for taking the time to post..wave to me and I'm no expert here.. but it sounds like she's after her cut of the house as the farm is in the mothers name..and even do the house is in negative equity your pal will be asked to hand over some amount of monies

My Own experience here is they'll do a deal on the steps of the court to see how much they can get out of your pal ...plus maintenance dunno

My advice would be the get a good family solicitor or legal aid as he's not employed would be better, as a lady early said it only cost her €50...

And lets not forget about the child he/she should come first here custody and issue can be sort out too..

Hope that helps ...Anyone else want to throw there pennies worth here ....dunno

Good luck dude...beer
