I have been living in my place of residence for almost 2 years. My first lease expired august of 2009. My land lady never brought me another lease to sign. I know in Texas that means it becomes a month to month lease. which is fine by me becuase i was thinking of moving.

Well she JUST now presents a lease dated back to august 2009 to august 2010 and wants me sign it. I refused becuase its backdated and seems illegal for that reason. I'm also moving in July becuase i finally found another place that i like and can afford. That will then hold me responsible for august rent if i sign that lease. I have given her the 90 days notice that i am moving which is more than required for a month to month lease.

I was wondering if anyone could help me find the actual law on this to present to her in a certified letter.

I'd just proceed like it never happened and count down my 90 days. She can't make you forge a document.

I would stay; the law is different in every state though and you should find out what law is there for Texas;

Just type it in the google space and go for it. They do have the right to give you 30 days notice though if it's month to month.

Don't back sign anything. Again, you need to find out what Texas laws are.

you already have it you are a month to month the most she can do is take you to court which takes 30 days then you will ask for time to get a lawyer if she says she wants you out thats another 30 days ,but most judges will let you stay as long as you pay dont worry to much you will have until the end of june

Just don't sign anything. If the first lease expired and you haven't signed another you are automatically on a month to month basis. You gave your notice in plenty of time, she can't do anything but accept. The risk is that she might try to hold onto your security deposit, so you might want to make sure that's worked out before you pay your last month's rent.

But if you think it's going to be hostile, get your valuables out of the place before the fireworks start.

you are almost right they will give her 30 days but if she ask for more time and if she has kids no judge will put her out my friend lost a building in tex because he could not get the people out it took a year poor

thank you to all of you for your response.

I have not and will not sign any lease agreement she now presents me with. I know that back dated lease is illegal.

I am concerned that she will try to illegally evict me. becuase she did do that to my nieghbors. They came home and all of thier belongings were on the front lawn and broken. Another reason I've been looking to move. As of right now she has not given me any notice to vacate.

But as a precaution I am packing up all valuables and moving them out as soon as I can around my work schedule. That way if she does the same to me I won't be too bad off.

I am also requesting her to keep all correspondence in writing for both of our legal protections.

I'm not concerned about the security deposit. I'm sure she'll come up with a bogus list of repairs and cleaning to justify keeping it. Now if she tries to say I owe her more than the security deposit there will be a legal battle.
