hi
I bought some books online last night as a friend said there was a huge sale on on easons.ie
I paid for them and recieved reciept.just in the last hour I got a mail from easons saying there was pricing glith on there website and they are going to refund me and as an act of goodwill allow me to have 1 book at 10c(I had purchased approx 30).
My question is legally can they do this as I have the reciept as proof of purchase and the price advertised at time of buying was 10c?

There supposed to honour the price at the time that you bought it in good faith. This has happened before lots of times in Ireland with the likes of Dell.ie etc.

I would say that Easons are chancing their arm, they know that most people will probably accept their offer and say no more about it. Write a firm but polite email back, stating that you have the receipt and want your books at the price you paid, the advertised price, and their offer is not acceptable to you.
They may get snotty about it and refuse, because they know it will cost you way more than the price of the books to take any action against them, in which case you have lost nothing, or they may send all the books you ordered at the price you paid rather than waste time and money fighting you, in which case you get what you wanted.

Price display in retail outlets
The purpose of the EC (Requirements to Indicate Product Prices) Regulations 2002 is to enable consumer to see the price of the product before buying and to make price comparisons. The price of products on sale in shops and supermarkets may be attached to the items themselves. Alternatively they may be displayed on a label on the edge of the shelf. Generally, shelf labels are used to display prices in supermarkets since barcodes have becomes more popular. Under the EC (Requirements to Indicate Product Prices) Regulations 2002, retailers must show the correct selling price in euro including taxes. Unit prices for products sold by weight volume or measure must also be clearly displayed. More detailed information on pricing of goods and services is available here. The Regulations provide for certain exemptions from unit pricing such as items which are equal or less than 50 ml or 50 grams. The Regulations also extend to online shopping. Services are not covered by the Product Pricing Regulations.

In fairness i checked prices of the books i ordered today and its close to e800 and i was charged less than a tenner,I have a detailed reciept with a list of all the books ordered and all at 10c each also vat and delivery paid. ordered and payment accepted.I just dont know how they can then turn around and ay oops? doesent seem right?dunno

Im a firm believer in karma but a friend told me there was an excellent sale online ,and I wasnt about to look a gifthorse in the mouth. and what can I say Iv expensive taste . I dont think I did any thing wrong? I went online,looked for books I wanted and purchased them at an excellent priceinnocent
Havent mailed them back,think Ill contact a consumer agency first and get some advice.ireland

10c? What sort of a discount would that represent? 99%? A bit obvious, no? If the error is obvious they can cancel and refund.

I'm just guessing most books are at least €10 these days, the cheap ones. What was the title, we can check on Amazon. Like I say, if the discount is obviously a mistake they can cancel. Anything up to 50% could be accepted but when you're into the 90%+ then no way Jose.

We shall see.......Those prices were up for 2 days .I hope I can get some of them,I have a kindle so do all my shopping on amazon but when my friend told me the extent of sale on easons I just ordered away. is there some legality that I dont know of that your not permitted to reduce goods below 50% that I dont know about wink

I heard of a similar mistake in pricing that happened a few weeks ago....it was VIKING the stationery company that sell online and on occasion have other products on special offer...large TVs were offered for 6 euro each by mistake instead of the proper price of 600.....naturally loads of people ordered them...
They discussed this on The Vincent Browne tv show and from what i remember the answer to your question was that VIKING did not have to honour the obvious price mistake....they could refuse to complete the sale....In your case it seems that they have completed the sale by accepting your credit card? and giving you a receipt.
This may put you in a different position to the VIKING case.

No, there is no legal principle based on a 50% of cost price reduction that I know of. What I am saying is that your solicitor would have to argue that you reasonably expected the price to not be in error and the reduction is so much in your case that that is not even remotely plausible. The retailer can withdraw an item from sale if there has been an honest mistake in pricing. Come on, you did realise it was a mistake, right? Which would mean....

I just checked their terms and condition Swan.

"No contract will subsist between you and Eason & Son Ltd. for a sale to you of any product or service unless and until Eason & Son Ltd. accepts your order by e-mail confirming that it has dispatched your order."

That's their cover right there. Your order is only 'accepted' when the goods are dispatched. Any email sent to you before dispatch is pnly an acknowledgement of receipt and not an acceptance of the order.

I think if you got a reciept for the books at the ptice you said,and they took the money out of your card, even if theere was a price error you paid for the goods at the prive that is on the reciept , thats there fault not yours,

You're quite welcome. The same thing happened last week with a site offering 56" plasa TV's for €6. One guy bought about ten and wondered why they weren't delivered. He was very indignant Ha ha ha

Facetowardsfront is right if you ordered paper books. I thought eason's online account was just PDF's or something straight to email? confused I'd still create a fuss and see can you get a few more goodwill books for 10cent or whatever. grin
