josingleinspain: Oscar Pistorius is guilty or not.

Based on the evidence that has been led so far, particularly on his own evidence under cross-examination, he is guilty on all three charges under the Firearms Act, and on culpable homicide (manslaughter). On the charge of murder we'll have to see what other admissions he makes on the stand and what other evidence will be led by the defence.

On the firearms charges he has led no evidence to credibly rebut the evidence of the eyewitnesses.
On culpable homicide - he says he shot in the direction of the door without thinking, Culpable homicide is tested against the standard of the 'reasonable person' i.e. would a reasonable person in the circumstances of the accused have foreseen that his actions could have harmed someone. A reasonable person would foresee that shooting into a closed door when it is suspected another person (intruder or not) is behind the door could result in harm to that person.

Good evening Ladydiz tip hat
If he is found guilty of murder and sentenced to life, does it mean "life" in SA, or do they serve only a short period behind bars?
Thank you tip hat

Evening Rebel wave

Murder carries a mandatory sentence of 25 years with a possibility of parole after two thirds of his sentence being served, unless the judge directs that there be no possibility of parole.

Culpable homicide carries a maximum sentence of 15 years.

Very, very doubtful he will walk without at least a few years. His earning capacity, even if he should get off scott free is zero. No company will use him to promote their products and that is where the money is, not in winning races. conversing

Rumour is there's a book and a film on the way, but it is the Steenkamp family driving that not the Pistorius clan.

That's a good point. I get most of my income from promoting products and it would disappear should I be convicted.cool

I really really hope he sits.. And that's all he will do, cause his legs will be taken away... (Could be used as weapons in jail)professor

I would be very surprised if he didn't. Yip, no special treatment in jail for him.

No he isn't. Merely a typical narcissistic arrogant personality type. Insanity requires pathological mental illness or defect - he has neither.

I have doubts on his innocence, 4 shots even if shooting thinking it may be an intruder does not add up...seems a sad state of affairs
