OK,
I had applied for a new job, just got a letter from them saying that I couldn't have the job because of the results of my background check, enclosed was a copy of the results.. had an entire page of criminal history.. and needless to say.. not one thing reported on it was mine.

ok.. I called the company that did the check to correct it, They told me that they found nothing with my SSN so they ran just the name, (I have a very common name- just looked in the phonebook and there are over 10 of the same in it)
so.. how the hell can they run just a name and use that as a report to keep someone from getting a job?? pulling up a report at random from anyone with the same name.

since the employer paid for this service.. and the service provider intentionally gave a false report that kept me from getting the job.. would this be a fair time to sue them???

What do you think?
BTW.. talking to lawyers tomorrow.

Yes...finding nothing by using your SSN means you have a clean background. Duh! I have a very common name...have to use my middle initial, and even then it's common. Run my name, I'm sure you'd have quite a list. Run my SSN, you'll have nothing because I'm clean.

Odd thing is..
I do have one misdemeanor from when I was 23, nothing else on my record, not even a speeding ticket.
and fairly recently got passed for a permit to carry a concealed weapon doh

but this one misdemeanor didn't show on the report.
just how reputable is this Companyvery mad very mad very mad

What would be behind the service provider intentionally giving a false report Ras? I would certainly be pissie if someone was tarnishing my name.

Why would you want to work for such a stupid company? Having spent most of my career in the public sector I'd run the other way and be grateful you know ahead of time what they're like.

I honestly have no clue, all I can figure is that they got paid well to provide a service, then did basically nothing and no effort to produce a record to get paid for??????

I still have the copy of the report from my current employer right here and is clean except for the misdemeanor.. {a correct record!}
and the records this company provided was in the ozarks in Missouri in 2004 .
I didn't move to Missouri till 2007 and can prove I was living and working In South Dakota then.

That's because that report wasn't you...and your misdemeanor is probably expunged by now. I have a DUI from when I was 21 or 22, but it's been expunged for a long time...means it never existed, and my record is clean as a whistle. I easily pass all checks into my background for my permits and my jobs.

I would...it may not have been intentional...but it doesn't have to be...he was negligent in performing his job/service and it cost you a job....based on falsehoods due to his negligence....wave wink hug teddybear hug bouquet

It is not the fault of the Company,
It is the fault of the other Company that provided the background check.

The company that did the background check is who I am considering suing.

I have never thought about suing anyone.. but I have been damaged by this company.

I can imagine what a jury would say.

The thing with juries is that they are notoriously unreliable. I wouldn't want to chance it. Why not get your own background check and take it to the company?

Will see what the lawyers say in the next few days.

If you saw this list of crimes that they claim I did (which I did not) you would understand just how damaging it is.
has a list of 8 criminal charges.

Then you could see why I want to sue them.
