You can delete whatever you like from paper or cyberspace - deleting from your mind is a bit more difficult. And why should you entirely - if someone affected your life so much, it is an important aspect of your life, so it shouldn´t just be tossed aside. Part of the lessons in life.
Rather than dwelling on the legal or not legally separated part - I would be more interested in whether or not the person was emotionally separated from the "ex".
I think it´s probably quite wise to test people you don´t know very well - especially with all the people around who wish to scam, or just play with people´s feelings.
