About a year ago I joined a dating site called be2.ie. I subscribed for 3 months and as there was no section to prevent auto-renew I presumed it would be ok. After the initial 3 months I tried to delete my profile as I didn't find the site any good but found that my profile couldn't be deleted until I cancelled my account. There wasw no facility on the site to do this. I have faxed them, rang them and emailed them on several occasions but they still haven't cancelled my account and keep taking €126 every 3 months from my credit card. I rang and wrote to my card company to ask them to cancel payment but they wont do it.

Any advice people?

Change the card account and number, for one so it's no longer able to draw money from the account. Secondly, get onto the bank's fraud section and go through the site and details with them as it sounds more a swindle than a Direct Debit. .

Once you have written proof that you asked them to cancel your account and they havent done so then I would presume that they owe you a refund unless the small print stated that you had to sign up for 12 months.
Maybe contact they might be able to help you or at least point you in the right direction.

Hi miss

The onl small print was stating that to cancel you have to do so 2 weeks prior to payment being due, which I have done before it's due every time.

It's like The Hotel California... you can check out anytime you like but you can never leave

Is it an Irish reg company?? I would send a letter to them at their company reg address along with proof of the dates you requested the cancellation along with your creditcard statements showing the payment. I would then demand a full refund of the amount.
Surely your bank must be at some fault as well paying it out when you instructed them not to. I don’t see why you should have to change your account and credit cards and incur more costs.

Read their T&C's (I work in a purchasing type of job). The cancellation process is there, can be activated online or by fax. The 14 day prior to expiry of th echarge period is nasty but legitimate. But if you have proof of having clicked on the cancellation button or have a copy of your fax that should be it and no more credit card charges

The termination must be requested using the respective link in “Settings” in “Premium Membership”, if available, or by facsimile. Thanks Peter but honestly the cancellation facility on the site just brings you round in circles. I have faxed them on numerous occasions and telephoned. I have copies of all the communication I've had with the site and have even forwarded this to my bank

If all else fails and you don't mind foregoing your anonimity then i would try and go to the newspapers. The consumer ombudsman might then decide to look into it, you will be warning others about this scam and they might be shamed into giving you a refund. Might not work but worth a shot. you should be able to stop payment through your card provider at anytime because it was you who set up the payment instructions, so you alone can stop them at anytime

Sheisters. Ok, then write a regsitered letter to the credit card company with the details of your cancelling the subscription, instruct them to refuse payment, refuse to pay that portion of the credit card. The creidt card company have the right to refuse to pay them (with your money I might add) That should do it. Peter

Yip you could always email the Ray Darcy show the usually have a panel of people for this sort of thing !!

Depends on how far you want to take this, there are a couple of ways of getting their attention (they're not registered in Ireland so you'll have to go to some bother).
- has their company details with names of staff. Make very sure you have a way of proving you faxed them (itemised phone bill with their fax number and a copy of the fax should be reasonable) as well as copies of the emails.
- Write a concise complaint and send it by registered post to the Luxembourg and Switzerland addresses on that page for the attention of the named director along with the documents. Give them 7 business days to confirm receipt (then set deadlines as appropriate, if they respond). If there's no response then take the numbers for the company register from each site and contact the respective company registrars office in both of those countries. You can usually do this online - again a concise complaint and reference to the supporting documentation.
- As Peter said, contact your bank. Do this via the credit card fraud department (ring lost or stolen if you don't have this number) and have your documentation available for them. Give them the date of your cancellation (according to faxes and emails) and tell them that all subsequent deductions are fradulent and you want them reversed.
- Check your statement/ask the bank to see if there are indications of a third-party processing facility. Many web companies route their payments through payment gateway services (examples are WorldPay and realex) so contact them as well. Inform them that if they process anymore payments against your card you will consider that fradulent on their part.
- If they're not using a payment gateway then they'll be using a merchant account. If you can determine the bank this account is held with then you can contact them as well.

Can't think of anything else for the moment as there's nothing else that stands out from looking at their site. There might be another route (based on the whois information for be2.com) but that has limited potential.
