Legally in the UK you are, but I doubt it feels like you're being treated as if you're innocent.

At least you still might have hope if you're morally innocent as well.

I'm not sure what the time limit is in the UK for being imprisoned while awaiting trial. I've just googled, I'm not knowledgeable enough to not be confused, but it depends upon the offence with a maximum in the order of about a year. If the trial has not been started by then, the accused is automatically entitled to bail.

In many cases, when the trial finally comes up and the defendant is found or pleads guilty, the punishment is TIME SERVED.
It's not punishment if the defendant is found not guilty.

It might not be labelled 'punishment', but it is in effect the same as time served.

And what would be unfortunate about that?
I don't find the idea of posthumous proven innocence appealing and rather untimely.

Tomcats2: thanks for that yeah ive wondered that we could charge him for inciting racial and religous hatred and i bet if it was a christian fundaklmentalist he would have been charged by now, we really neeed to extradite him to set an example that religous intolerance will not be excepted in the Uk

Extradite him for what, Tom?

He hasn't been charged with anything.

Not even for inciting racial, or religious hatred.

Given the men detained without charge for prolonged periods appear to be all Islamic, or of Eastern origin and given the media reporting which provides no evidence for its assumed hostility, I think it might be us Brits who are guilty of blatantly inciting racial and religious hatred.

A bit of a sticky situation that, eh?

sounds more like guilty until proven innocent!!!

we should be very certain that ppl are guilty if were to take away their freedom...but every system has its flaws/mistakes and occasionally an innocent will suffer as a result.

on the other hand...can we take the risk of letting violent criminals walk the streets while awaiting trial??? many cases where these kind were out on bail only to commit even worse crimes while out and about!!!

It's not considered punishment by the court, if found not guilty.
