No,whether they are under the influence, or driving whilst impaired, i believe the punishment should be the same. Bearing in mind,although ignorance is no excuse, the drug could be a prescribed drug for a medical condition.If the drug is a controlled drug, there could be offences under the drugs act anyway,ie, posession ect, so thier punishment could end up worse.

I'm more worried about the other 90 percent of the population talking on phones, eating and putting on makeup while their car is going real fast. Or, alternately, the people who drive under 20 mph or over 40 mph when it's snowing.

Well, in my opinion, DUI in the USA is nothing more than another tax. The powers that be say it's for public safety, but think about this. All over this country there are DUI offenders with 3,4,5 and more DUI offenses that are not in jail. Judges keep releasing these people knowing they will get caught again. The reason is simple. When someone is arrested for DUI, everybody gets paid. The court gets paid, the lawyers get paid, the driving school gets paid, the insurance company gets paid. It's a money racket. This is the primary reason they drop the legal limit of alcohol in the system. So that more taxes can be collected.

Having said all that, i still believe we have to have laws governing impaired driving. Don't arrest people for drinking one and a half cans of beer. But more importantly keep the repeat offender in jail for a while so he learns a real lesson. Then maybe the safety issue would be legit.

Now as a matter of full disclosure. About 27 years ago i had 2 DUIs. It cost me less than $500 for both.

My primary gripe is that law enforcement is just tax collectors. When a county commission can't vote another tax into law. Just tell your local sheriff to write more tickets.
