Obama's Imperial War in Libya Subverts the Constitution

What if President Obama raised taxes without congressional approval? It sounds preposterous, yet U.S. presidents now routinely wage war on their own—and in Libya, Obama isn’t even pretending Gaddafi poses a threat to us.

Suppose President Obama announced that, in order to protect the nation while carrying out his constitutional duties as commander in chief, he was issuing an executive order restoring federal income tax rates to their Clinton-era levels. Suppose he justified this action by referring to the powers the Constitution supposedly vested in him to wage war on his own initiative. Suppose he argued that, since the Constitution grants him this power, it would be absurd to claim that it denied him the necessary concurrent power to raise revenue so that he might fulfill his constitutional responsibilities.

I suspect most lawyers and law professors, although perhaps not the indefatigable professor John Yoo, would consider such an argument preposterous on its face. After all, the Constitution specifically grants Congress the power to "lay and collect taxes." Only Congress has the constitutional authority to impose taxes, an authority it has exercised by enacting the Internal Revenue Code. The president's role in the matter is limited to executing that law faithfully, proposing changes to it, and vetoing proposed changes of which he disapproves.

All this is American Government 101. Yet when it comes to waging war, American Government 101 has, since the middle of the 20th century, been replaced gradually by American Government, Special Roman Imperial Edition. Our latest splendid little war is the most striking example of this trend to date.

For Obama and Clinton, military adventures in foreign lands are not wars if one’s intentions are sufficiently pure: then they become humanitarian aid delivered via Cruise missiles.

On Wednesday, Secretary of State Hillary Clinton deigned to inform Congress that, while it remained free to pass whatever resolutions it liked regarding the Libyan war, any such resolutions would be ignored by President Obama. Clinton also made clear that the administration had no intention of abiding by the provisions of the War Powers Resolution, the law Congress enacted, over President Nixon's veto, in 1973, that confirms presidents have the power to respond to genuine military emergencies without first getting congressional authorization.

Consider what a complete inversion of the constitutional order Clinton's remarks represent. The Constitution grants Congress the exclusive power to take America to war, every bit as unambiguously as it grants Congress the exclusive power to levy taxes. Following in the footsteps of every president since Truman, Obama seems to be completing a reversal of the American constitutional system, one that now has reached the point at which presidents claim, in the words of Professor Yoo, that Congress lacks the power to "place any limits on the president's determinations as to any threat, the amount of military force to be used in response, or the method, timing, and nature of the response."

Indeed, Obama's actions in Libya go beyond the legal powers Yoo's employer, George W. Bush, claimed to possess. As overblown as the Bush administration's claims were about the threat the Taliban and Saddam Hussein posed to America, they were not as outrageous as a claim that Col. Muammar Gaddafi's ragtag dictatorship represents a military threat to the United States.

And Obama has not—at least not yet—made any such claim. Instead, he has decided to go to war for what are presented as humanitarian, rather than defensive, reasons. (The most Orwellian feature of the destruction of our constitutional order has been the campaign to call war anything but war. Apparently for liberal interventionists such as Obama and Clinton, military adventures in foreign lands are not wars if one's intentions are sufficiently pure: then they become humanitarian aid delivered via Cruise missiles.)

None of this is itself an argument against the war in Libya. Perhaps it's desirable, or even morally imperative, for Western nations in general, and America in particular, to enter another civil war in the Middle East. But the framers of the Constitution had very good reasons for making it difficult for America to go to war. They knew that even wars that begin with the best of intentions often end up being driven by the worst ones. They also knew that while war is almost never in the interest of a nation's people, it is often in the interest of a nation's rulers, who reap the political and economic benefits of war while bearing little or none of its costs. That's why they designed a system of barriers to action—which is, after all, what the rule of law is supposed to be—before politicians could send others off to kill and be killed in the name of the noble national goal of the moment.

Barack and Hillary's excellent adventure presents us with a particularly mordant irony. The endless blather from neoconservatives and liberal interventionists about how our wars will give birth to the rule of law in the Middle East ignores how those wars have led an increasingly imperial presidency to mock the most basic requirements of the rule of law in America.

Actually for once a good question from Dude.

Is China a socialist country? Answer, yes. Who did Obama do the T-Bill deal with? China. Why? To support a big socialist government in the United States. When? His first year in office. Prior to health care. Prior to the Afghan surge. Prior to recovering the US economy.

President Obama T-Bill deal strengthened the Chinese economy and the Chinese currency. The same currency, he and the administration now say is fixed. What did he expect? The same economy, that is a major competitor of the United States.

So what is the socialist agenda of China? One to limit human rights. Two limit any and all political opposition. Three to promote a socialist expanse in the world.

Has President Obama come into conflict with any of these three principle agendas of the Chinese?

1) When the Hgullie rebelled, hear any White House talk of a no fly zone over the far western side of Chine to protect them from the Chinese military. See even a little effort from the White House to build a international coalition on China regarding this?

2) 1000s of Political prisoners are in China. China hackers intrude into google and other social site to get net information. See the Obama administration challenge the Chinese acts legally? To even task them on their human right positions?

3) China supports NKorea. Another socialist state. Yet the Obama Administration would break apart the group of 6...for independant talks....only to see the NKoreans sinking SKorean vessels and firing on SKorean Islands. Playing into making China desire to be a power and dominate in the region. Effecting the national security of Japan, Taiwan, and South Korea negatively.

REP King just received a bloody pigs foot in the mail. Along with a rant accusing him of being Jewish. And saying the soon all Male Children in America will be named Mohammed.

The vile mailing was detected by the US Postal service and now the issue is being investigated as a threat.

REP King is Christian.

Btu this brings us to a very interesting situation. President Obama has the ability to offer REP King additional secret service and other government security in light of these kinds of threats and Muslim rants.

He also has the ability to do just what he did during the Gabbie Gifford shooting, asking that the rhetoric....especially this kind of inciteful rhetoric be done away with.

REP King is a sworn officer of the Federal Government. When Janet Naplantion had threats recently, she got additional protection. When other DEM have gotten threats, they get additional protection.

Rather I suspect that the President will continue to focus on the vile and inciteful Quran burning of Pastor Jones. Obviously when a government cannot consider both to be vile and just inciting, it has decided to take sides. It fit into his Muslim outreach concept.

It is like the no fly zone over Libya. This too fit into his Muslim outreach concept. President Obama took a side with his decision to make a bombing no fly zone. Yes he could have made a non bombing no fly zone. Were only Libyan air assets that were flying were engaged. But now with only 1/3 of the Libyan heavy weapons destroyed....this according to NATO....the Libyan issue has become a stalemate.

But he really cannot condemn the action of Qdaffi enough to warrant placing troops on the ground. Or to keep US military present over the country. Or to order a decaptation strikes on the good Col. That also goes against his Muslim outreach concept.

President Obama has let himself be hand tied by the Muslims in the world today. He has to give considerations....for their oil.
Special clauses in UN sanction on Qdaffi to assure him that American boots will not come into the country. Selling weapons to the Qdaffi regime. While American Congressional REP get the most vile of messages from Muslims.

DSA's main program focus through the rest of 2008 will consist of (1) working to help ensure the election of Barack Obama and (2) continuing work on the Renegotiate NAFTA petition drive.

Work on the Obama campaign will include:

1) email blasts and other communications issuing from the National Office attacking McCain/Palin and explaining the necessity of voting for Obama,

2) encouraging locals to do DSA-day volunteering en bloc for the Obama campaign,

3) circulating pro-Obama/anti-McCain literature that YDS is developing to nonyouth DSA members,

The Libyan Rebell leader....just came out with a statement....saying NATO is not doing enough to protect
his forces and the civilians on the ground from Qdaffi's forces.

Qdaffi's forces have melted into the civilians both chaging uniforma dn placing heavy weapons into civilian area to keep the NATO airstrikes from reaching them.

With the rebellion now.....staling and seemingly in a stalemate....the finger pointing begins. Did the US come in with the no fly soon enough? Was it effective enough to cause QDaffi to leave? Should the ceasefire occur? Can you force Qdaffi to ceasefire?

What to do ...what to do.... I hear the White House a near never used broom for sending dictators into the dust bin of History.
Maybe it is time to break out the heavy dust bin equipment?

China is a Communist country which have opened up for free marked economy some years ago and this policy have been good for that country for sure.

T-bills isituation accured because the amount of money borrowed from GWb administration from China was too big being possible to pay on time and then T-bills were used in order to pay them back.

China is a suppressiv regim but unfortunatily too strong and it is not that wise creating a war situation with them when results will not be good for any body... not for China not for the USA and not for any body else.

China is supporting NK regim but since they also got the key regarding real negotiations with that regim then it is wise using China,s influence in that troubled country and positve results may accure some day soon. NK is not that strong or any thing like that but they can dammage South Korea major time and then it is best trying what ever diplomatic means in order to make those two countries negotiate for real... actually they are negotiation much behind sceans and China due to it,s huge need for american freindshsip is playing a positive role.

There is much more condumnations of the Chineese regim during Obama administration than it EVEr have been during GWB administration and no Republicna on charge would be able to do much more or threatening them with war and so on no matter how much Republicnas are lying a bout this now on days because they are not on charge and then can easily saying some stuff which is not true what so ever and just a fart in bathtop... for ever Republicna style of talking issues and some thing Republicans never will change!

Honorable american forces are not totaly out but on stand by and will get in again if asked for it by Nato. Beside America supports the mission logistically and in order to make sure security of the involved forces as the most important part of and decision maker of Nato. How many times shall I rmeind you preisdent Obama does not need your bloody GOP deciding for him what so ever. doh

For now... French government and italian government mainly got real issues in their countries because leaders suck and have created huge problems in those countries... both Sarkozy and Belusconi are crooks and buzos and got ana dministration full of liers and then they both need creating some kind of popularity before coming elections... let those countries both doing the job for now and if they are not able to take care of the job America will be asked to help again.
