Different View of Illegal Immigration

Guys, this situation is so much more complicated than just stopping people and checking ID’s.
Before all of you get upset when the phrase “racial profiling” is brought up, hear me out.
We all agree that illegal immigration is a huge problem and has been a problem for decades.
You have different facets for the illegals: the majority is here to make a better living and the others are criminals.
Everybody is saying the Fed Gov is not doing its job and these are coming from your governors and senators. Are they not part of the Fed Govt? Why haven’t they done anything before?
As a black woman I am very aware and have experience with “racial profiling” and so have members of my family. I do not know if you understand what it feels like to be stopped for no other reason but the police think that you are up to something. But this is a big aspect of this new bill. They already had something similar; they just added this new twist.
For the illegals that are here to work, how are they working? Who is employing them? You can’t put all your hatred and disgusted feelings on them, employers here in the United States have employed them.
The Pima county sheriff of 52 years gives several reasons why this is a bad idea. No one is disputing the fact that these people are breaking the law, but like I said, it’s so much more complicated than that.
The ones to blame are the people who have continued to allow this to happen all these years: politicians, police and civilians alike. The people who come here illegally are equally to blame but all should not be placed on them.

Have you noticed that the majority of attention is being placed on immigration when our economy is still in the tank and the Wall Street thing is going on? These guys wrecked our economy and like it or not, the immigrants have been here and wasting our time and energy on this subject is just what they want to keep us from getting to the bottom of these crooks.
If you notice, a lot of people are very emotional about this situation and politicians are very good at going for your emotions.
I’ve read the statute and it is does not clearly say that the police can only check your papers if you are legally stopped. There are so many loopholes in that thing that it can be very much abused.
But that’s not my main purpose for writing this big ole paragraph.
We, the citizens of the United States of America have bigger problems that we need to focus on and get our country back into shape.
While this is only some of the views of this topic, please let me know what are yours.

As I do not live in your country I am ignorant of your laws. From reading your blog I take it that anyone can be stopped and asked for ID?

We had a similar problem in Australia years ago with illegal immigrants obtaining work. The Government introduced a tax file numbering system. Off course there will always be ways around it but it has stemmed the tide somewhat.

And the Government is getting what they really want -- income tax.

Im going to take my dog for a walk now and there is no need to take my ID. Its already in a microchip in the dogs neck.

Well, I don't care who lives here. This is the melting pot and no one "owns" it. People just like to think they do. My issue is that people are coming in, taking advantage of what America has to offer and not paying like the rest of us do. I have to pay taxes and medical insurance premiums. I have to fill out a census form and carry a social security number. I can't just go to another country without jumping through multiple hoops. It needs to be fair to Everyone, not just the minorities or illegals. It seems the pendulum has swung back the other way to the extreme here.

I agree with you though. We have bigger fish to fry and our government is notorious for causing distractions to hide their abominations. The oil spill is another one. While it needs to be dealt with, it is causing a nice distraction from all of the bigger greed bs that is being brought out into the open.
i have worked along side of illegal immigrants the ones i have worked with are good people better than a lot of american citizens that i have worked with . all they want is a better life for their families as we all do . however they are not completely innocent the true culprit is the companies that hire illegal immigrants . think about it if you can't get work as an illegal then you have no other choice but to go through the proper channels . i have had no experience with the criminal element of illegal immigrants therefore can offer no real opinion . as for the economical instability everyone wants to be a millionaire while everyone is holding onto their money so they can stay a millionaire that takes money out of circulation if you wanna know where your tax money is going google politicians annual salary .
Some of the ones I've worked alongside were not crimminals either, at least they didn't act like one but I will say that one in particular did not have respect for our traffic laws. He laughed about not having a license and was in several car wrecks but that is what's so messed up about this whole situation. There are good people and there are bad people. They are all breaking the law but you have to look at their reasons behind it.
Ur right, if the companies didn't hire them then they would have no reason to come in under the radar but the states are filled with greed and how can we combat that?
Arizona's law is drastic but unneccessary if they pointed the finger in the right direction.
They should be paying taxes like the rest of us and the US should make it easier to come here in a less complicated manner and that's for all that want to migrate to the states.

Thankfully there are some up on the hill that see this as a distraction for what it is and will continue to work on the mess on Wall Street.
i have a salution to the whole problem ........ invade iraq ........ what do you mean we already did that ? hell just throw a dart at a globe wherever it hits that's who we invade .
i apologise it was getting too serious in here but if the u.s. would just make mexico a part of america there would be no border to illegally cross . as a plus the taco development around here would get a boost how could anyone not love that ?

Hmm…you’ve given me a lot of info to process. First thing, there is a lot of emotion in your statement and seems that you have gone through quite a bit. I cannot begin to comment on anything that has happened in your life because I do not know you.
As far as “racial” profiling, I’m fair enough to say that there is reverse discrimination but not to get off the subject of what this law entails….it’s kind of different.
Now Brewer has changed the wording in the law but it’s basically still the same thing. There’s no way that a police officer can tell you are illegal unless he goes by what you look like.
What does Obama have to do with this “now” being a major event? What entitlement do the people feel they are entitled to? To work? Yea they don’t pay taxes and that is really wrong.
Like I said the ones that are here to commit crimes, you’re not going to see them freely out on the street. I can’t speak on what happened to your friend because I don’t know anything about it. As far as the agents “ejecting” those that are caught, did you know that part of the law is to imprison them for up to 6 months I believe and charging them a fine? Who’s going to pay for that, not them! I don’t know the answer to this mess that has been going on but I know there is a better solution to this problem that we the American people have sat on for decades for many different reasons. In a way, America has been sold to the world as a safe haven.
Securing the borders is a start but first I think the motivation for coming here needs to be cut off. The biggest one is “JOBS!”

This bill is just one good step away from all the hidden agendas and socialistic ideals currently being spread around our country like wildfires. We need to focus on protecting our own country first, and stop trying to be so "politically correct" and accomodating to those who manipulate our government and our laws. professor grin cool
Adamisk, maybe they should set up a secret task force like the Navy Seals or somebody that knows what the heck they are doing and their sole purpose is to catch these drug runners and I don't even want to know what they have to do in order to get it done, as long as they get it done.
Your right Drea, first thing we need to do is get our money back from all those crooks on Wall Street and anyone else that profited off the recession by nefarious means. Get companies back to hiring and get this economy back on track. Illegal immigration hits a sore spot in all of us but I really believe that this is a smokescreen to divert our attention from other things. If you look at all the anger out there, I'd say it's working.
Drea, yes I have read SB 1070 and I will state that I am by no means a lawyer but I have to ask you where in the bill did you get that information? Cause from what I've read, what you stated is right under the heading "F. THIS SECTION DOES NOT APPLY TO A PERSON WHO MAINTAINS AUTHORIZATION FROM THE FEDERAL GOVERNMENT TO REMAIN IN THE UNITED STATES."
If that's not the section then tell me where it is because I would really like to understand your perspective.
You want to say that only people that have been racially profiled can only see the bill this way, well check out this article and tell me if these baseball players are playing the race card.
An immigrant is different from an "illegal" immigrant and if that is your argument then immigrants of the US are not "illegal" therefore they have rights just like you and I. If you are an "illegal" immigrant then you get no rights. You are supposedly hauled off to jail and sent back to the border when caught.
An employer should have the right to defend themselves if the allogations are not true because that is the American way.
So tell me please, where in SB 1070 does it state that "illegal" immigrants have rights.
Here are a few excerpts that give allow for due process of the law:

The attorney general or county
29 attorney shall not investigate complaints that are based solely on race, color or national origin.


A PERSON MAY BRING AN ACTION IN SUPERIOR COURT TO CHALLENGE ANY
12 OFFICIAL OR AGENCY OF THIS STATE OR A COUNTY, CITY, TOWN OR OTHER POLITICAL SUBDIVISION OF THIS STATE THAT ADOPTS OR IMPLEMENTS A POLICY THAT LIMITS OR RESTRICTS THE ENFORCEMENT OF FEDERAL IMMIGRATION LAWS TO LESS THAN THE FULL EXTENT PERMITTED BY FEDERAL LAW.

…A person who knowingly files a false and frivolous complaint under this subsection is guilty of a class 3 misdemeanor.


H. On determining whether an employee is an unauthorized alien, the court shall consider only the federal government's determination pursuant to 8 United States Code section 1373(c). The federal government's determinationcreates a rebuttable presumption of the employee's lawful status. The court
12 may take judicial notice of the federal government's determination and may request the federal government to provide automated or testimonialverification pursuant to 8 United States Code section 1373(c).

Employer can challenge entrapment, but must prove:

THE EMPLOYER
29 MUST ADMIT BY THE EMPLOYER'S TESTIMONY OR OTHER EVIDENCE THE SUBSTANTIAL ELEMENTS OF THE VIOLATION. AN EMPLOYER WHO ASSERTS AN ENTRAPMENT DEFENSE HAS
31 THE BURDEN OF PROVING THE FOLLOWING BY CLEAR AND CONVINCING EVIDENCE:
32 1. THE IDEA OF COMMITTING THE VIOLATION STARTED WITH LAW ENFORCEMENT
33 OFFICERS OR THEIR AGENTS RATHER THAN WITH THE EMPLOYER.
34 2. THE LAW ENFORCEMENT OFFICERS OR THEIR AGENTS URGED AND INDUCED THE
35 EMPLOYER TO COMMIT THE VIOLATION.
You are correct that the new follow on bill that was added now states that racial profiling is illegal. The bill, however, does not change the language of that anyone could be stopped or questioned. There was an additional add-on that civil violations will be part of when they check for illegal status. So they can stop you for any small reason and check your status, so that doesn’t change a thing. This bill is so open-ended, it basically just says the same thing. Did you check out the website I gave you? What are your thoughts?
Just FYI, the section on the employer was already part of the law, the entrapment part was amended so that the employer could sue or get out of the charges. If this bill passes, wonder which ones will be safe cause they have the money to lawyer up?
Drea, I’m just asking you to take a look at all sides, you can’t say you did because look back at our discussions, you pretty much stayed on the mindset that this is all the fault of the illegals and the people milking the welfare system but you have no condemnation for the people that are running the show.
Thanks Bobby, you are correct. Seems like everybody has their hands mixed up in this situation and everybody wants to point the finger. This is something that we all have to fix and if that means getting on the politicans, employers and those that are here illegally then it needs to be done. Like I said in an earlier post, this has been going on a long time and a lot of people have profitted from this and it's not a simple black and white issue.
If they had started off in the way you have just described, we wouldn't have this gigantic mess today but I have to put this in, don't let this immigration bill distract from the really big problems that are plaguing us now, i.e. wall street and now this giant oil spill.

As far as open minded…..well….the chapter is still open on that one.
Actually, if you’ve read all the typing that I have done, you would see that I have given several points of views on this bill. This bill utilizes the local police as well as the feds. Looks to me that after everything I have written, you have just focused on “racial profiling.”
As far as “condemning those that run the show,” and you really want to know, go back and read what I said as well as the other comments.
The government is not separated from the president and there are a lot more people against this and if you had read what I wrote, you would see a few more.
Again if you read what has been written, you would see that no one is condoning illegal immigration. But it points out how more harm is being done than good and way more complicated than just “show me your papers!”
As far as the Castle Doctrine, “way off topic” and what’s your point? Yes I would protect my home and family if someone were to bust in and if you are comparing that to this bill….I have no words for you my dear.
You said you’ve read the bill, have you listened to the patrol officers that deal with this every day? Of course they are dealing with people crossing the border, they’re shooting each other up down there.
If you really want to know what I oppose then read what I wrote and get your focus off of “racial profiling” because I’ve said other things besides that.

But to respond to some of your views, it is not a matter of putting people in planes and shipping them back to their countries, they are right across the border. As far as illegals rallying, I hope it’s not illegal immigrants that are rallying cause I do believe that they have no right to rally on illegal immigration because it is “ILLEGAL” and that is not what the rally is for. Nobody is for illegal immigration, that would be BS but if you read what some of the views you will see there were other things to rally about and you will see that I am not defending Illegal Immigration!

You have pulled out a quote of many and it pretty much says what my blog is about and according to your comments you have pointed repeatedly to “racial profiling.”
This was a civil back and forth commentary till you decided to compare me to child (what’s up with that?)
You say it sounds “pretty simple to you,” but all I’ve done is point out that there are many other aspects to this topic. That makes it more than simple.
How is my saying looking at the entire picture “political propaganda?” Focusing on one topic and inciting high emotions is political propaganda and that is definitely not what I have brought up. Please look at the definition and tell me again that I am spewing propaganda.
I will say again, I don’t have the answers but if you look at the entire picture and start from there, ideas will come to fix the entire situation. I am not going to go over my views again because they are stated quite plainly throughout my comments.

The new provisions of this bill is not securing the borders which is what several people in government have been fighting for more people to man the borders but it hasn’t been done.
YOU may not care about a baseball team but just to point out, it’s about more than one team and also they care! You keep looking at how an individual thinks and how this effects them but I’m pointing out looking at the entire picture. These kids don’t mean a thing to you but an entire franchise means something to the state of Arizona. I pointed this article out to you because you made the statement that people only think this is racial profiling because “in some way they themselves” have been profiled and they are “clouded” by racial injustice. These are the owners and people that run the ballparks where these kids try out and practice that have a problem as well with this bill.
The Castle Doctrine is YOU protecting your residence, place of work and your car for example. Are you saying that US citizens should now go out and start defending the borders themselves? If they see someone who is possibly illegal in the store, protect the store? From what, shopping? If they are robbing the store, sure do something but the SB1070 and the Castle Doctrine is not the same thing. Again I ask you to look at ALL aspects and not just certain parts.
Drea, my going back and forth with you now is not making any sense. I’ve posted my views and have asked for others. That is why I started this blog, not to “prove” anything to you. You’ve asked for me to tell you time and time again to point out my views. As I have stated before, several of my views are written out in the heading of my blog, comments responding back to you and to others who have stated their own views in response to my blog.
I see you like to play with words but when comes down to it, you took the low road by calling me (I am the one who made the statements) a child and ignorant.

We can all agree that you do not agree with anything that I have said and that is your right. You have given your views and now it’s time to move on.
