Freedom of Speech clause:




Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

But where does the Governments right to say protect "methods and souces" under the remit of "national defence" impose on the citizens right to say or express any opinion?

And does "cyberspace" or the location of the server come into play?

We have laws a changing over ere regarding that, and some counries are "havens" for servers as they do not recognise he laws regarding say what The American Legal system or the UK for that matter have in place.

The 1st Amendment only applies to a public forum in cyberspace where it is owned by the government or performs some sort of governmental function...otherwise it does not apply....wave wink thumbs up

If you're trying to apply any other law then it goes by the law of where the company or server is located....Like the recent Myspace case where the woman pretended to be a boy who had a crush on a teen girl and she ended up committing suicide...the trial had to be held in Los Angelas I believe because that's where Myspace is located sooooooo that gives that court jurisdiction over the case and U.S. law is applied....thumbs up

Some Countries don't recognise that law though, so it's impossible to get cooperation from certain governments.

Were not talking of say the Northern Korean or the Cuban government here, i could name one in Europe (Scandinavia).

It's a naughty trick question, but a clue is they don't have extradition agreements with the US!

Yep it was a naughty question of me, i know!

I'm familiar of a case where someone leaked some info into the public domain, and he ran to a part of Europe where the US couldn't officially get their hands on him.

The case.....

The lockerbie terrorist incident where a 747 was destroyed.

The book he released was withdrawn, and the content was shall we say...well....clearly someone (his former employer) in the American Government wanted him back there ASAP!

If your interested i'll email you the book details, but it isnt hard easy to find, but the reason isn't it was a poor selling book!

Was a brilliant example of real lack of freedom of speech.

Pound to a penny he is no longer breathing though.

Honestly, the Bill of Rights will only protect us if we protect it. We have had a President recently put in place some things that infringed it, and try to put more in place, all in the name of Homeland Security. And most of the sheeple here weren't even aware of what was happening to their rights as they voted it in.

Interesting thread, Robbie...you got me to make a rare appearance in a political thread...combination of title and author of it.

I havent seen the site threatening to delete peoples profiles if they discuss this type of thing?

Moderating a site is hard work, believe me, i've done it.

The site have mentioned previously that they don't censor too much because the prefer to let the forums police themselves.

In my experience deleting threads during or after say an argument say ids for one reason and one reason alone, and that's to try to keep the peace and try to make the public speaking area of the site have a more friendly atmosphere.

The mods won't comment on a specific case i would say, but this isn't to say they won't notice what's typed.

They might well just decide to stick to their own internal policy and not broadcast their reasons why anyone is deleted.

Moderating is hard work, so please bear this in mind!
