MySpace Suicide Case Leads To Tougher Laws

After the troubling suicide commited by a Missouri teenager due to an Internet related incident, state lawmakers voted and gave final approval yesterday to a bill which will deal with cyber-harassment.

The bill is expected to cover several aspects of the new wave of technology, identifying as illegal the harassment from computers, text messages and many other electronic devices, besides the well known written and telephone communications.

Republican Governor Matt Blunt, who will soon sign the final version of the bill, issued a statement saying that the social networking sites and technology have provided criminals with a whole new set of weapons against their victims and the new protections and penalties are highly needed in order to ensure a safer environment for everyone.

Lori Drew, 49, was indicted on Thursday by a Los Angeles grand jury for her alleged role in an online hoax that led to the suicide of her 13-year-old neighbour Megan Meier of Dardenne Prairie back in 2006.

Lori Drew was accused of creating a fake MySpace identity under the name of “Josh Evans”, a 16 year old boy, making friends and later harassing Megan not long before she committed suicide.

On October 15, 2006, the so-called 16 year-old teenager Josh Evans turned against Megan, sending her negative comments, and ending with a harsh message: “The world would be a better place without you.” According to a police report, Megan later hanged herself in her bedroom closet.

Under the current state laws, the maximum possible penalty that Lori Drew can receive is of twenty years in prison.

Personally I agree with tougher laws....annonymity has protected these kinds of people for long enough and I think they need to be held accountable for their actions.....wine

I think that this will be really hard to enforce, although I agree with the intent of the new laws.

Alot of vulnerable people seek comfort on the internet, and unfortunately there are alot of sharks in cyber space.

Suppose where do you draw the line. Do you only retrospectively prosicute someone after the other person has harmed themselves, or do you try and police the net more and apprehend people pro-actively, then you get into freedom of speach issues.

Yes, agree with both posts. Hard to define and outline what the laws would be, hard to enforce them, etc. It's another example of social understanding not keeping up with technology...

I think you do both...be proactive and prosecute....and no it won't be hard to enforce...they caught this woman...so they can catch others all they have to do is track IP addresses and then get information from the service providers and sites etc....It's not that hard for professionals to do.....If some sort of harassment leads to someone harming themselves then yes...I agree they should be prosecuted...I'm sure there will be a clear definition of what consitutes harassment and what constitutes harm....If you are culpable and held responsible on the street...then you should be in cyberspace too.....wine

Arlene101: I read about the story and it is so sad and I wonder how many others we don't hear about. I think we were all insulted some time or another before we had computers and it Hurt, so I can imagine how much easier it is now to bully!!!! So Sad!


I'm sure there are a lot of cases we haven't heard about or like this case in the beginning there was no statute to have the people responsible charged under...I think it's high time the law recognizes the reality of what people are capable of on-line and the fact that they depend on annonymity to get away with the things they do!!!!!!!!!!!!!!

For once I'm going to have to *strongly* disagree with you, H&K. Essentially this criminalizes being an a**hole. To be logically consistent, if one favors the above law one would have to favor criminal penalities for being a jerk, which I think would be insanity. I'm not saying that cruelty and verbal manipulation aren't unethical, but if you criminalize them then virtually all aspects of human relationships would be criminalized (again, if one is being logically consistent).

its a fine line between control and being controlled - theres all kinds of netiquette guidelines for people to tap into - most facets of society have their vulnerable people - I would have thought this was something which could be addressed by the education system rather than by legislation dunno

Crossing the line from a**hole to harrasser and abuser though as I see it are 2 different things....If you can't harass people in real life...or misrepresent yourself in real life..then why should it be any different on-line???? Especially when the consequences can be so dire!!!!!!!!!!!!

Is a good idea basically, but laws already on the books are not enforced.

not enough gov agencies and staff to enforce it all.
so this will turn out to be another unenforced law until harm is actually done.

Just like a fake check that a person sent to me to make a purchase from me, was a check for over $1600.
since it was fake, I called the FBI.. bit was told that they wont go after it because they don't have the manpower.

Freedom of speech is one thing, Harassment and fake profiles to play with people is another.

I think all sites should have to keep an IP address list of ALL members!
we know many do not give a real address, but in most cases, one ping is all it takes to know exactly where this person is sitting on their computer!

But how to actually fund the enforcement of these new laws?

True...BUT if they consider it important enough to change the laws..hopefully they will make sure there is enough money available for enforcement...as far as money being lost due to scams...I would think priority rules enforcement and they go after the larger amounts first...and there is so much of it that goes on they probably can't keep up....Just a guess....wine
