I dont know what the laws are in NZ but in Aus we have a specific building law that means builders are required to put aside funds that will cover tradesman and wages. (cause of the bad old days and the collapse of a number of builders mid project)

Now if they havent done that its a simple matter of reporting them to our building authority. Perhaps there is an NZ building authority where you can start your search for the missing $$. If all else fails the authority can get a lien against the outstanding funds and garnishee them when the builder gets paid..

Oh and here in Aus its a small claims matter where you can take them to court yourself.... look into that side too. You can sue for wages via Small Claims

Its totally out of line... and it sucks big time ... hug

I understand redundancies here but I really don't know anything about employees wages/holidays payments when company goes into liquidation and boss declares backruptancy

but I will look into and see what I can find or if anyone reading this in NZ knows the laws regarding this, if could help out. wine

Hi tarnsnz,
It sure does suck big time but your son will be fine soon enough as he is a diligent worker with skills. Not sure what your laws are like, but should be similar to Oz, where if you are retrenched or fired through no fault of your own, you are eligible for immediate payment through social security benefits, instead of the usual waiting period. That should help until he (soon) finds another employer worthy of his hard work.

Here, have another, but don't get too sozzled...wine

Yes, Venere I am sure he can get a emergency benefit but there's always that word (pride) laugh about going into those horrible places and funny enought, he was saying last night "can't break family tradition" and go in there which I fully understand as just like his mum laugh

He said to me, "you will take care of me" for a little while won't you", and damn well knowing I will laugh

Just means now, I can get him to do more jobs around here and he will be spending alot time on golf course which is all good so we don't drive each other crazy laugh

What mums are for, we get through this I had better be well looked after in my retirement years, no bloody rest home for me rolling on the floor laughing wine

I know what you mean, Tarnsnz. While the system is there for genuine need, if it's anything like Oz, most people hate anything to do with social security.

When my son transitioned from school to the workforce, we did exactly the same. I fully agreed that he have nothing to do with 'those idiots', and I supported him financially until he got on his feet. To this day, however, even though he's worked for years, I have never asked him to pay for food and lodging. He's been able to buy a property, and moves into it next month. I'm hoping he doesn't shove me into a home either!rolling on the floor laughing

I have dug some information that may help you.

I could be wrong but it ios not allowd for some one to sack an apprentice. If merory serves me well (I could be wrong) thr employer has to find a new employer for him. And from what I gleemed from the above site his boss has to have set aside his wages in a fund just incase.
Good luck and I do hop it all goes well.

Thanks for that link Oldbussy

ps. he wasn't sacked, all the workers including foreman lost their jobs, and company is now in liquidation - there is still a chance he and other workers may get monies owing to them through the liquidation process so there is still a little hope there.

As for the help here, he did ring and enquire regarding the redundancy packages they brought into nz a while ago and what a lot of rubbish - don't help him barely at all unless he had kids.

Isnt that typical of system

very mad

was told he could go on dole - what a joke, but he's not worried, he would rather find himself another job and not stress other it as whats done , has been done doh

tarnsnz: Ok, updat, good news & bad

Bad news, his boss is more of a arsehole that what I orginally thought

Son actually took out insurance when he had his car loan and sorted it all out and just needed a signiture from his boss & he was covered. So rings him and he didn't want to know about it, not his problem How can anyone be horrible after what he did to them all.

Son could of just left it in his letterbox to sign and pick it up - no big deal but didnt want to know about it. So son took the paperwork into receivers for them to try & get Good news

Through word of mouth, he got a phone call last Friday for a building job interview this morning

and started work today

Its for 2 weeks, and if all goes well, they will offer him a permanent position so awesome
thats great news tarnsnzyay
