after a week of bloody pain that should not have been, am going to cancel appointment monday and see another surgeon. Will seriously consider sueing the bloke who did this to me. Would not normally sue, but then would not normally expect to have pain through the whole time of an eye operation either.

go get a second opinion first, let the second specialist know the full story and let them handle getting your operation records.

also go back to the doctor who referred you and discuss it with them.

dont say anything about sueing until after you have gained a second opinion, and hopefully your original operation records.

There are Specialist solicitiors that deal with this sort of thing.


I'd be speaking with them, get some professional advice about where you stand. hug

Yep, softly softly does the trick. If you mention the word "Sue" (or even Suzannah) everything will clam shut. You need to find another specialist (in the same field of course) and work on the "I just want to get it fixed" line. Information will come as the second opinion goes, "Tut Tut ..." But specialists don't want to be tied up for days in court when they could be making $140.00 every 15 minute consultation.

Getting the right solicitor is probably a must.

Yes they do. But there is also a fair amount of competition between them. That is why you need a solicitor. He will find ways (with a barrister) of asking questions that are incriminating while not putting the second opinion doctor into the "potting on one of us" class. ie the doctor will "tell the truth, the whole truth" and the court willdecide on guilt.

Only from a friends experience - it is very hard, if not impossible to get a medical professional to stand in court and criticise, go against the actions of a fellow GP/Surgeon whatever.sigh

At the end of the day they stick together like peas in a pod, and don't fall for one of those law firms that advertise "no win, no fees".

No fees maybe but COSTS, such as court applications, photocopying, requesting documents, requesting medical reports/x rays etc., statements preparation etc etc etc can add up to tens of thousands.

And if you don't win, yep, you don't have fees to pay but maybe tens of thousands of 'costs'. But hey, JMHO. hug

Sorry to hear of your pain, but doctors/surgeons are not gods - even though some of them think they are.
