If a couple is pursuing a "legal separation" (not just the two parties going their separate ways) but making their separation legal and binding...anyone on here have any input what should be included in such a separation document?

Has anyone on here "lost out" on something because they forgot to include it in the separation papers...or thought it wouldn't be important or an issue at a later date?

I never had a legal separation. We separated in different houses and then went through the divorce. How does that legal separation work?

I have a legal separation agreement with my ex. Make sure that everything is clear about the children, where they spend there time and when. Childsupport, if there is a benefitplan that your ex cannot take the children off. Make sure that schooldecision and medicaldecision have to be made together.
For us it is mostly about the kids what is really important to both of us.
And make sure if you have money or inherent money he cannot get his hands on it.

Thats what i'm trying to find out here...what exactly does "legal separation" mean, and what does it entail...and how does one secure yourself in this instance..

I am sooo trying to find out-------Mu soon-to-be ex won't sign anything at this point!!!!!!!!!He is driving me nuts!!!!very mad

Ours was made up by my exes lawyer and I had a lawyer read over it and sign it. That makes it legal, getting it signed by a lawyer. He paid for making it and I was on legal aid for my lawyer.

But you can always go to the FLIC (free legal information centre) in your area. There mostly in a courthouse and a lawyer will be there certain times to give you legal advise.

That is probably the best way to go. Then you know (or at least you hope) your information is correct. And they can probably tell you more.

My husband wants us to file for a legal separation...i'm just not sure what i should be careful of in this type of thing and i don't want to "lose" what rightfully should be mine, nor make things worse for me. I know going to a lawyer is the best thing, problem is i don't even know what questions i should be asking or what issues i should be addressing...that's why I wanted some input here...

No lo contendre divorces are cheaper. You both sign a paper and agree to it. I wonder why he doesn't want to cooperate. Do you want the divorce but not him?

I had to file for a legal separation from my ex husband to prevent him from being able to take off with our children. He had threatened to take our children and without separation papers he could legally take off with the children.

I bet there are folks who have went through the divorce process more than once. Legal separation might be better before a divorce on the off chance that difference could settled before actually going through the divorce process.

I don't think he would try to take my kids. I am not fighting with him over the house or his truck(that I bought out of an insurance settlement). I just want my kids, dogs, freedom, and my SUV(I just bought in Feb.). I just want OUT!!!

Your best bet will be to talk to a lawyer to make sure that everything is in it. Because after you sign it is a pain to get things changed. Every lawyer has an hour or so that they give free advise.....

I know divorce is final...and am quite sure that is what i ultimately want, but i want, as you said, for the dust to settle before we take that route, so i am in agreeance for a legal separation...i don't want what i do as a "single/separated" person to be used against me at some point down the road for leverage....

I do in a way agree with you...I just want out...but i invested 13 years into that marriage...gave up my career to have children and be a stay at home mom...he has a 70K/yr job, I work part time just to get out of the house...should i really just walk away?

I had a courtorder for the visitation for my youngest one. That is a different ex. And he still took off with him and the police couldn't do anything because the courtorder didn't specify that they could intervene. Finally 2 days later I had a different courtorder stating that the whole Ontario police force had to assist me to locate my son.
