I remember a case in California, while I was living there, a criminal sued a homeowner whose house he was braking into. There was another case of a man who broke into a house, and had his fingers bitten off by the family's Dobermann. He managed to get into a closet away from the dog, where he bled to death. The robber's family sued and won damages.

There are also instances where a homeowner is in the right for killing an intruder but lose a civil suit by the family of the intruder. I have heard that the civil suits are more stressful than the killing of the intruder
That is one thing I like about Texas. If you are sued because you shot and killed someone who posed a treat to you or your family, the dead persons family cannot collect any monetary settlement from you in court. After all, we are still the wild wild west and we still do have prairie law. The law also states that a "threat" doesn't have to be with a gun or knife or any weapon of sorts. A threat is any communication where you feel your life might be in danger. Then you can use deadly force. However, when the police get there, you don't tell them that you killed him but that you "STOPPED HIM" from attacking you. After all, it is against the law to "KILL" another person. But you can use deadly force to "STOP" them.

If it had been a real burgulary, the friend would not have hung around outside sitting in the car waiting for the police to arrive after hearing shots and seeing the lights come on in the house.
I'll bet the supposedly stolen handgun had never been reported as stolen.
The only evidence for "burgulary" was that the sofa had been overturned and some cushions pulled out of it. That doesn't sound much like a burgulary to me. It sounds like a hasty effort to give the appearance of a burgulary.
Why would a kid disguise himself, break into his own grandfather's house (armed) and then overturn and tear up a sofa before engaging in a gunbattle with his grandpa?
A more likely scenario would be that the kid came to see his grandfather, an argument ensued, the angry grandfather shot his grandson and then, in order to make it look like a burgulary, produced a ski-mask and a second gun for the corpse, and then hastily overturned and tore up the sofa before the cops arrived.
Meanwhile the hapless friend was waiting outside in the car unaware of what was happening inside.

Premeditated for 6 months by the grandfather.... that sounds more likely than the grandson looking for drugs or drug money and planning on killing his grandfather by stealing the grandfathers handgun and using it in other robberies.
But then again, maybe I didn't present this in a ways for the simple to understand.
