Criticism that the Senate has become little more than what one member calls an “EXPENSIVE LUNCH CLUB, ” Congress returned for the fall session yesterday, with  pressure mounting on Senate Majority Leader Mitch McConnell to address gun violence, (resticting your Consitutinal rights) election security and other issues.

Trump wants Congress to pass the new U.S.-Mexico-Canada trade deal. And Congress needs to fund the government *by the end of the month* or risk another federal #Shutdown. But the president roiled talks by shifting $3.6 billion from military projects for 175 miles of BORDER WALL and fallout continues over migrant detentions. Questions of impeachment hover.

Schumer: We Will Force a Vote to Terminate Trump’s Emergency Declaration

During a speech on the Senate floor on Tuesday, Senate Minority Leader Chuck Schumer (D-NY) announced that Democrats will force a vote to terminate President Trump’s national emergency declaration within the next month.

Schumer said, “As stipulated by the National Emergencies Act, Democrats will once again force a vote to terminate the president’s national emergency declaration. The provisions of the national emergency act dictate that the resolution of disapproval be privileged, and therefore must be voted upon.”

Trump has the authority to declare a national emergency under the 1976 National Emergencies Act. This law essentially allows a president to define what he believes constitutes a national emergency and subsequently make a related declaration, the Washington Post reported. This declaration then allows the president access to specialized funds via certain emergency laws.

All recent presidents going back to Jimmy Carter have declared at least one national emergency during their time in office, CNN noted. For his part, Barack Obama declared 13 national emergencies, with many of them focused on international affairs and containing foreign conflicts, the outlet reported.

The Justice Department told a judge Friday that the House Judiciary Committee shouldn’t get access to secret grand jury material amassed during the special counsel’s Russia investigation, even as it weighs whether to pursue impeachment.

The response comes nearly two months after the committee filed a petition in federal court arguing that lawmakers need to obtain the grand jury material in order to determine whether to recommend articles of impeachment.

In court papers filed in federal court in Washington, the Justice Department argued the committee HADN'T PROVIDED A SUFFICIENT EXPLANATION about how the material would help in the panel’s  investigations of President Donald Trump. The government also argued that ANY POTENTIAL IMPEACHMENT PROCEEDING IN CONGRESS WOULD'T BE CONSIDERED A "JUDICIAL PROCEEDING” UNDER LAW, for which the information could be disclosed.

The Senate voted 54-41 to end the emergency declaration, and 11 Republicans joined Democrats. In March, the Senate made a similar attempt but also failed to reach the two-thirds majority, prompting Trump to veto the bill.
