Tricky topic. Here, the courts try to avoid sending mothers to jail unless they done something serious. Those that do go to jail, I'm not 100% sure what the law is surrounding care of the kids. I know women who have served time yet had no problems with keeping custody of their kids, they were looked after by other family while the mother was away. The idea here is try not to break up the family as it used to be done a lot in the past with bad results.
Depends on what age they are. At 18, they are considered mature enough to leave and live on their own though not all do. I know when I was in college, if I thought I was being spied on, it wouldn't have went over good and would have most likely just put a permanent rift in the family.
You get some greedy heartless family who wants the money while in the meantime the old fella is probably not suffering that much, they pressure the hell out of him to go through with it.
