No,whether they are under the influence, or driving whilst impaired, i believe the punishment should be the same. Bearing in mind,although ignorance is no excuse, the drug could be a prescribed drug for a medical condition.If the drug is a controlled drug, there could be offences under the drugs act anyway,ie, posession ect, so thier punishment could end up worse.
