It's questionable whether Garrett killed him or someone else.
One of the best pieces of evidence that Garrett didn't kill him is that it's known that wanted posters were put out on him at least a year and a half after his alleged death.
Also...
It was long rumored that Butch Cassidy & Sundance were not the ones killed by Federales in South America.
Awhile back it was determined to put the rumor to rest.
Their graves were opened, but only one set of skeletal remains was found.
DNA testing suggested the remains were of neither of them.
Butch's sister remained adamant well into the 20th Century that Butch returned from South America and lived out his life peacefully under an assumed identity.
In the movie, Etta Place parts company with them.
That was factual.
She then vanished from the annals of history.
According to one rumor she died of appendicitis shortly after the parting of the ways.

There was NO conviction because there was NO trial.
Ed made his first appearance in court to be charged with killing the Pepin County Sheriff & his brother, a Dunn County lawman.
A large crowd had gathered in the courtroom. Ed supposedly made a remark that infuriated the crowd/mob. On a prearranged signal, he was seized by a group of men, noosed, dragged from the proceedings & swung into the air from an oak tree in the courthouse yard.
It was an "extra-legal execution", more commonly referred to as a Lynching.
After killing the Wisconsin lawmen, Ed & brother Lon Maxwell had made good their escape. Hall County, Nebraska lawmen caught up with them some weeks later.
Lon again escaped and remains at large - whereabouts unknown.
Ed was returned to Pepin County for trial.
During the train trip to Wisconsin he made the statement, "I'll never leave Durand alive."
His assessment of his situation proved accurate.
I just discovered another coincidence.
Ed was born in 1852 - one hundred years before I was born. Weird.
Charles & Milton Coleman were the lawmen brothers killed in a gunfight with the Maxwell brothers. They were the first Wisconsin lawmen killed in the line of duty.
Ed Maxwell was the last (most recent?) person lynched in Wisconsin.
Ed and Alonzo Maxwell, however, have been lost in history compared to their counterparts.
They killed Charles Coleman of Durand and his brother, Milton Coleman of Menomonie, Wis., on July 10, 1881, in a blaze of gunfire along the Eau Claire Road. The location, at the northeast end of the city of Durand, is near the present intersection of Highway 10 and state Highways 25 and 85.
Subsequently, Ed Maxwell was lynched on Nov. 19, 1881, from a tree on the courthouse lawn in downtown Durand."
According to the coroner's report, he "...died of injuries sustained when he fell down the courthouse steps."
1881 - Ed stretched hemp at an extra-legal execution.
A hundred years to the day later, I got a life sentence - marriage - in the same courtroom.
It was life sentence for wife anyway
Our wedding took place immediately following a drunk driving trial.
After marrying us, the judge gave us a wedding present - a six pack of Old Milwaukee Beer that had been evidence in the preceding trial...
