As I posted about yours Dru, there are some young people that do know it all. Not only my daughter but two younger women in my office could see what was happening in my love life. I didn't take their advice because love is blind and believe me, I regret it.

I asked two attorneys the question, am I legally obligated to advise the bank that they made a mistake to put money in my account that isn't mine.

Both said, yes, I am obligated to tell the bank.

When I asked, what statute says that, they said, "I don't know".

Both said it would be theft by deception.

Both said they didn't think I would be prosecuted.

Both said I couldn't keep the interest on money that isn't mine.

You are so correct HJ when you say respect is long gone for elders.

On another note though, if I had listened to my daughter, I wouldn't have lost all the money I had to a low down user.

And I certainly wouldn't have been heart broken by the same user.

The young ones are wise...not all of them....but some have more smarts than I ever could have because they look at things when it comes to romance with common sense, whereas I used to look at them with my heart.

Since I work in a law firm, I'm going to ask the attorneys if I would be prosecuted for the scenario presented here. It may take awhile before I get back and then it might not.

Ambrose, that's why I wrote that if I was caught and was taken to court, it would be in the Chancery Division. I don't think the judge would prosecute me simply because there is no law, that I know of, that says I have to return the money.

I wish SV was in this thread cause she would know the answer to this.

However, there is the law of integrity and that's another story.

I would just leave it in the bank.

If you take it out of the bank, someone will wonder why you are taking it out.

Someone said it would accrue interest. If it's not your money, can you keep the interest earned on something that truly isn't yours to begin with.

I know all about removing $10,000 from the bank. The IRS has send me forms several times when that happened.

Would it be my responsibility (forgetting about integrity) to return what was given to me in error.

I'm sure the judge would think of me as low down scum for not advising the bank but who cares. If the judge sends me to prison, I'd have memories of a hot blooded lover on the boat.yay

What's the difference of "getting away with it" and how you would spend it. If you spend it, you ARE trying to get away with it. My plan, as you mentioned, would be to spend it the way I said. As long as I don't give it back, I am trying to get away with it. I think ARealGuy wants to know how you would spend it.

I agree Babi that this poll is rather condescending. I read into it that he's wondering, what "senior folks" good for. What do they have to offer. Someone said euthanasia. Well, I guess you could kill all of us that are over 55. Let me know how that works for you. devil

When I joined the forums in February I was attacked and bashed pretty quickly by two certain people. I was hurt and truthfully couldn't take it so I left but didn't do a thread that I was leaving. After about a month I came back under a different name because I missed the communication between posters. This time I was prepared for how people express themselves and chose to ignore it. If I left again, I wouldn't do a thread about it unless it was for a temporary leave such as illness. When I do threads it is to encourage conversation and opinions between people. I don't write about the misery of my life unless it helps someone else to tell of my experiences.
