It's one of diminished responsibilty where the defendent, having become unemployed due to the pandemic watched excessive amounts of Fox News which influenced his thoughts and behaviour.
His defense is that he believed the propaganda and false narratives promoted by Fox News and Trump himself, so his nefarious behaviour (including ignoring the pleas for assistance from the police officer who had head injuries and died of a heart attack on the day) was not really his fault.
There is both an element of veracity in the defense and a diversion from personal responsibility.
It requires a carefully balanced outcome for justice to be achieved. The consequences of this case as it has been posed, will likely have ramifications.
