A solicitor should take instruction from the client and advice given or work undertaken should be in relation to the instruction given but as you ve found out that s not always the case. Make sure there s no comeback on the existing proceedings before you start anything new so a visit to courts office is a must. Your biggest concern is the lack of a seperation agreement i m o
word of caution . .make sure you both read and understand everything thoroughly . .god knows what could have inadvertently slipped in there or been left out when things were being put together given the way things have been turning out
Ok dont do anything yet. .can you (or the 2 of ye if you re ok with that) go into the circuit court office and find out the current state of play with their file. Sounds like its been allowed lapse by one side or the other. Was it last year you were served with papers? If so thats a long time and if you did nothing since then she could have it granted if you failed to file an appearance or a defence, in any event her solr should ve sent you a 14 day warning notice if you failed to enter an appearance or defence. She should be able to go for a grounding motion for summary judgement but its best that the court request her do that. .nod and wink side of things! When she served papers on you there should ve been a letter of consent for you to sign. If you signed that consent it was up to her solr to apply for a court date.
Well its in her interest to get it sorted. No reason why you should be jumping through hoops with lawyers and being their cash cow. Did something happen that you suddenly lawyered up and posted this?
Sounds like it should be a 'no contest' case if all is as you believe to be true, basically if you served the papers and had all your sworn affidavits in order then all she had to do was let it through uncontested
Was there a legal seperation agreement? If so and there s been no change in circumstances it should in theory be a matter of rubber stamping it. Cant understand why its taking 2 years if ye both agree. Have court papers been served by any party yet? Keep an eye on your filterbox
