I get the impression you think she's not guilty, and so nobody else should think she is either. You seem very confident it is her first time, and it's purely out of desperation. That's ok, it's good to show compassion. Hopefully she gets a fair hearing in court, and help addressing whatever her actual problem is.

No, I agree with you, she is guilty obviously because she actually committed the act and being that this is a hypothetical situation, I was just curious of the feedback of others. Would some people find her guilty and throw the book at her so to speak or would others basically feel compassion/empathy and find her innocent and help her get the help/resources she needs.

i would find the defendant guilty
and use a therapeutic sentencing option that provided counseling.

counseling would be intended for emotional support combined with education/information regarding associations which provide services for folks in need.
These could include services available, grants, low-income subsidies, organizations and companies that provide discounted products and services, home and budget information, support groups, education upgrading, possible training programs, recreation facilities, ....there's more...but you get the idea.

having said that, i'm canadian and there are some supports in place. but one has to dig for them as the information isn't readily available to the folks that need it the most.

Hotrodlarrys,I understand but like in most states most dads are considered dead beat dads regardless. I agree that no one really knows who the father is.

Friskyone: A single mother, working two jobs, steals a loaf of bread and some milk from a grocery store to feed her hungry (child or children) out of desperation, and it's the only time she had done this.

She survives paycheck to paycheck to pay for rent, prescriptions, utilities, gasoline, car insurance, clothing and toiletries. All of which are necessities and food with nothing left over for anything else.

If you were a juror or judge, would you find her guilty and prosecute her or would you find her innocent?
Not guilty!!
I'd give her a warning...but would also try to help her out.

guilty, put her in the electric chair.
Stealing is bad and by doing it as a mother you give the wrong example to your children.

There's always a place where you can get help, or a person willing to help you, so by stealing she didn't think.
