As far as I am aware an engagement ring is given as a promise of marriage. If said marriage does not occur then the engagement ring in theory should be returned and the owner can do with it what he wants. If however the two people concerned marry and wedding rings are exchanged, then that engagement ring belongs to the recipient, along with the wedding ring.

As far as the legal position goes..... an engagement ring is given as consideration/payment for becoming engaged. It's ownership by the prospective bride is not contingent upon the marriage actually taking place. Practice and precedent show that the possibility of an engagement not concluding in a marriage is a foreseeable event, therefore, when the ring is given the giver, being a 'reasonable person' (legal concept) has foreseen the possibility of no marriage and has accepted the risk. Thus, upon giving the ring, ownership thereof is transferred to the prospective bride and the prospective groom has no legal claims of ownership on it.....Well, that's what I would argue in court, anyway

Yes. And, it might interest you that in SA law it's still possible for a spouse to sue the person who has an affair with his/her respective spouse for 'alienation of affection'...something to consider before acting on impulses..

SoonerGal: My ex-husband in the 2 years we have been divorced almost got married twice, well recently he has a new gal and gave her the same engagement ring that he had given the previous too...I personally think this is tacky...just another reason we're divorced what are your thoughts on this, is it tacky or acceptable?
As long as he doesn't expect them to both wear it at the same time, I think it is acceptable.
Seriously, how did he get the first one to give it back???

Why do you care anyway? Spend your energy moving on with your life, not caring so much about what he is doing that you spend valuable time creating an opinion poll about how others judge his actions.
Who cares?
You think his actions are tacky. You are no longer with him. That's his problem and the women who take him on now.
