Now since this happened in the middle of the night, I believe when you are attacked at a different time, would it make it any lesser of your thinking for the defense?

I don't know, I think this jury is truly out of their mind.

I do feel sorry for the teenagers and wished it didn't happen, but the truth is that the poor old man, who is to claim he didn't feel threatened?

Butterflies, yes I think that if it is a plain thieving and it is not done in the middle of the night and in your house, I would try to fight back without killing but when would you think it that way, I don't know.

Yes you are right Non. There were no criminal proceedings going on against them to prove that they were truly committing the same crime, that I can read anywhere in the story.

But for purposes of the clarity of the judgement, they didn't put any weight on that either.

Of course candy. The question, that is hanging over my head is this. Was it because he was more prepared than that being expected and had himself armed made the jury so sympathetic to the very act of the burglary itself?

Dedo, the only weapon they found was the tool they used to break the window to get it as was in the first time. And they were the same kids.

In the paper today mentioned about such an appeal just to spend more so much money on such a litigation. The fact of the matter is there is a crime involved and since there is not a specific protocol on how you actually be threatened by such an act, wouldn't be the government burden to be specific on the law itself?

Go figure my dear Butterflies and that is what is boggling me because here is a retired peaceful man and subject to such an act and now found guilty? Wouldn't this an encouragement to young kids who would do the same thing? As if it is alright to do what they did? And then on top of that who is to tell when you feel threatened and not? When you feel the imminence of danger to your very life?

No one will ever have to take care of me Luke, thank you very much, I am perfectly capable of doing that myself and the trip would only be for the purpose of finding a way to improve humanity and if you are not on my side of the defense you would be of no use to me anyways..

But having said that, doesn't mean, I can't offer you a cup of coffee, now right? And if this invitation is rejected, no worries Luke..

@India yes, it changes your perspective completely if and when you suffered the pain of such inhumanity.

At Lou, yes my dear, it takes a lot of pain to endure such a crime and endless sufferings that is beyond justifications..

So now having proven that these people will commit the same thing over and over again? Why wait for it to happen again?

India, up until it happened to my brother with beautiful family 4 children and a beautiful young wife orphaned and not to mention that my brother was a very good man. Yes, I didn't see the justification of them being dead. But after that, if and when these people as callous, heinous and inhuman as they are, they do deserve to die, no matter how it is, although I most favor, the sedation and injection, than anything else.

And yes to your idea of prevention Lou, I have always been on the positive note on this. But if indeed, there are people with no remorse and they are not even aware of the commission of such a heinous crimes then that is the very reason I suggested about the focus of the medical field to manipulate some technology relative to such an isolation of such an abnormality..?

But whether we like it or not and just as some out there out to kill and torture us, I would definitely do it myself, like Z mentioned albeit, HUMANE AS WE CAN.

Well the crux doesn't really lie on the government trustworthiness on this alone Z. Remember? But yes, perhaps it will fall just as much as the case on EUTHANASIA?

I was just thinking out loud Z, perhaps there will come a time truly when we can say: HEAVEN IS UPON US?

But in anyways, only when you have become the victim, like my brother that we do go deeper on the relief of such a pain, to not let these people go back again and again and victimize others.

it has been proven that those released went back and committed crime after crime again..

Emotional impact and sufferings are no doubt the very good portion why most countries in the world do mete DEATH PENALTY Luke, which took me a long time to reconcile on the belief then that God has the only right to take life away. Just as what right these criminals has to take those very life only God can?

But in the process I have, after, the most painful sorrow I have encountered for the torture of my innocent brother.

Now that said, I do favor the use of such a measure as a deterrent to such escalation of crimes. Cat proved the cause and effect factor in your country.

Now @ Lou, I have changed my mind since weighing all the factors that there is a justified reason for people to take life in a humane way which is far better than the way the criminals have so callously and inhumanely have don.

And I will, come one of these days, Luke as was in my bucket list to come and live there, perhaps in Kenya..

I am looking at the expense, and the latest reported in the US for keeping and maintaining minimum prisoner per person a year is about $33,000.00. For a maximum, it cost between $92,000 to to $200G per person per year.

Now given these figures, would you still favor the cost of keeping them for lifetime? And there are criminals sentenced up to 400 years. (Frozen Ground)

I am not sure Luke? Anymore as I have started believing that death doesn't make any crime any better or does it?

If we can truly prove that any commissions of these crimes premeditated or not are but a result of abnormality in the genes, can't we at least agree, that indeed, there is a cure or remedy?

AT Lou, yes in the history of criminal process of investigation, but with the advent of DNA, it is amazing how much easier to truly produce factual evidence about the convictions of such criminals. The innocent then outweighs the number of those who are truly guilty to mete the right judgement. And then perhaps there will be no more innocent sent to jail.

Regardless, being humane which is the focus of this blog is taken into consideration...

At Non, how are you my friend. On the Punishment versus Redemption..I do believe yes, for those who are remorseful and has a way of looking at their crime an act of injustice to fellow man, perhaps punishment is a measure that serves well the purpose of rehabilitation and repentance and atonement.

Redemption on the other hand are for those who truly would say: "Yes I am a bad seed, not worthy to live this life and therefore deserve to die." But given that kind of declassification or characterization before hand, can't they just go and commit themselves before hurting others?

Does the knowledge come before the act?

@ Z I have to clarify that the measure I had in mind wasn't prejudgment before the commission of the crime. Rather a seek to find a cure for such a disorder, which of course covered very broadly by Iotaoo in terms of the factors evolving from such behavior. I figured with the advance of such a medical breakthrough we can isolate the bad genes and completely eliminate them to create balance in any individual that lacks the pattern to be normal.

It is not an easy process, but my experience with exposure to so many kinds of people, I find out that there are always those that will never be pleased and difficult as those that are so easy to deal with and just positive.

Yes Z. Thank you. I am aggrieved so deeply just why such things like these is part of our lives. We that can't seem to have the stomach of such a vile and evil acts. I am crying as I am writing this and can't ever finish my book for my brother and because the pain just go deep down and render me helpless to think of the evils committed by such perpetrators.

The question, truly, is do they, since you said, remorseless..deserve to be truly treated as such? But treating them so inhumane, would make our society safer? And justified?

Dedo, I am so appalled that you are not edified for this act. Such is your expectations that women are saint? And not capable of the very nature of man's acts much like yours?

Although I have never done it nor will be looking at it in the near future of my life, and neither do I personally know anyone who has done so, doesn't mean to say that it is not possible now is it?

But where it is a crime to be soliciting for such an act like my country, then perhaps the record is much too scarce if not nil at all.

But you should embrace your pride on this DEDO. Or were you expecting a second serving?

I love snail G. Just so you know it is one of the richest in protein, according to the Health magazines and we have abundance of them in my birth country.

In France when I was there, ESCARGOT meal was like gold in price and let me tell you, it is sold here in the US at @$35 dollars a pound in shell and dried..

So yes I will be so happy to have dinner with you my friend..
