Help !!!! Pinky and I have a real problem People from Germany please respond

Okay I am from America and Pinky is from Romania so we need some help from anyone in Germany who has had a tenant who refuses to pay or leave.

We have an apartment we gave an eviction notice to these deadbeats for not paying the rent or even the deposit we charge 300 euros for the rent and 150 euros for hot water heat everything but electric.

A couple days after we had a process server give them the notice we git a letter from a layer saying they were fighting the eviction.

We are paying their heat and like I said everything bit electric and we dont have the money to hire a lawyer because their refusal to pay has put us in a financial bind.

I want to shut everything we pay for off but we dont really know wht our rights are as landlords

So if you are from Germany and have experience with this sort of thing please advise us what we can and cant do

Hi Checkers, not sure if it's still the case, but in Germany it's hard to get someone out of an apartment.

Only thing I can think of is if you claim "Eigennutzung", giving your tenant notice because you want to live or better have to live in that apartment yourself. It has to be convincing though if your tenant wants to fight your claim. dunno

Yes Checkers, even if they refuse to pay the rent. Found the following:

You can't just get a tenant out without a reason.

Mietverhältnisse in einer Wohnung können seitens des Vermieters aus folgenden Gründen gekündigt werden:
Nicht unerhebliche schuldhafte Vertragsverletzung des Mieters: Beispielsweise Nichtzahlung der Miete oder ständig verspätete Mietzahlung. Hierbei kann sogar eine fristlose Kündigung ausgesprochen werden.
You can cancel the contract if the tenant doesn't pay. It doesn't say how you get him out if he refuses.

Eigenbedarf des Vermieters: Wenn der Vermieter die Mietwohnung für sich selbst, seine Angehörigen oder beispielsweise einen Pfleger benötigt, kann er kündigen. Die Umstände, die zur Eigenbedarfskündigung führen, müssen aber nachvollziehbar sein und vom Vermieter begründet werden. Verfügt er jedoch über eine weitere Wohnung im gleichen Haus, die nicht vermietet ist, muss der Vermieter diese dem Mieter anbieten. Das Angebot bleibt bis zum Ende der Kündigungsfrist bestehen. Wird der Eigenbedarf nur vorgetäuscht, hat der gekündigte Mieter ein Recht auf Schadenersatz sowie auf erneuten Einzug in die Wohnung, sofern diese noch leer steht. Außerdem müssen dem Mieter Unkosten für Umzug, Renovierung und Mietdifferenzen erstattet werden.

If you claim you need the apartment for yourself. You have to prove that though, and if they find out it was only a pretense, you are liable for compentation. You also might have to pay costs for moving, renovating und difference in rent.

I would get some sort of legal counsel tbh. Maybe try to ring Haus & Grund, I don't know if they give information for free though.

There is a too strong protection of tentants under German law, heard of lots of people getting no rent, houses wrecked etc. and nothing they can do or any compensation. dunno You can get in trouble with the law quickly, even if it's your place and you are right.

are you in the house down stairs ? gosh I'd cut the power off first ,and the water so they carn't flush the lou ....and if they wont move , get some prawns and put in the hems of the curtains , and put some into a blender and spread along the top of the doors ...and put prawn juice into a water pistol and spray that around as well...

in a few days in the sun the smell will be too much! and that should do it , ok wave

@ Checkers - If it won't affect anyone else and you are insured, pay someone to burn down the apartment... then they will have to move and the insurance will pay for a new one.... devil
you could have a chat to the people who you got your morgage with , they might know of a way ......wave

I am not in Germany, but many laws in the EU are similar.
If they are deadbeats, they probably have the help of a free lawyer provided by social services.
