Service Animals

I’m opposed to cases being decided by precedent. It appears that the majority of stalemate cases of this kind are usually settled in favor of the person needing the service animal. I suppose one could think of it in terms of riding a bus, airplane, subway, or renting an apartment, etc...where there are bound to be some people close by who are allergic. It would be ridiculously untenable to expect the foresight of this, so I kind of “get it” that the service animal would certainly prevail. It’s not, in my view, about who “deserves” the greater priority, but what cognitive thinking would dictate as “what is reasonable”. However, because this is The United States, I believe each individual case should be heard on its own merit, as constitutionally orchestrated, rather than being decided “on precedent”, which can be, and often is, far too broad. handshake

Sunday Morning Research— Hope I’m not over-doing this topic, but it really does interest me. I’m giving the exact point of this morning’s research, so that anyone can check up on me ( so no one will think I’m just rambling...)laugh WL:Wood & Lamping Attorneys At Law——- “The Clash Between Service Animals And Allergies In The Workplace”. Condensed ( by myself) — reasonable accommodation MUST be provided to BOTH. However, there can be no expectation that the employee (with the allergy) seek another job, as that is NOT considered to be reasonable. confused Hmmm...it sort of leaves it at loose ends, because interpretation of what is reasonable is different case-by-case. So, what the law firm is suggesting is that the person with the animal may come in, as long as the allergic person is not affected by the animal, nor is compelled to work in another area or seek other work. Now, how does the business make that happen?

See why this is so weirdly, wonderfully interesting? A catch-22. Sort of like a guild-career requirement that you are skilled before acceptance, but can only get that skill within the guild...( ie plumbers)

Service Animals

Thank you for a very well-thought out, sage overview. I completely understand. A blind man absolutely needs his seeing-eye dog; and it would more likely than not be easier for the deli worker to find other work than it would be for the blind man to find another way to live safely in society. I can’t cite a particular case, but here in The Pacific Northwest people with disabilities have tons and tons of rights, and well should. Yes, court cases unilaterally have found in favor of the person needing the service animal. I just wanted to know if you, et al, thought it was fair. (I think, in this context, it is fair...I, personally need some accommodation myself, but it hasn’t been a big deal...no service animal is involved, and the need is minor enough to not cause a kerfuffle. I do recognize that disabled citizens are often ignored. Nobody wants to deal with it, sometimes, anyway. Thanks for writing.teddybear

I guess I was wanting to know how people “see” human rights, and just who’s should get the better consideration over the other: the person ‘needing’ the dog, or the person needing the job. It’s a fair question. By the way, no, it is not the same everywhere, there are jobs where for the greater good, ban animals, ie electronics companies’ sterile rooms and offices, hospital operating and recovery rooms, etc...so, no, the allergic employee will not always have to be exposed no matter what... Again, the priority question is,— given that both sides have valid issues, WHO gets the better end of the stick, so to speak, and, do you think it’s fair?teddybear

We get a little antsy around here, as The Southern Coast is approximately 265 years LATE in a geographical-changing combination earthquake/Tsunami. (We actually have free bi-annual classes about how and what to have ready to grab and go; routes to fall-out shelters, quick routes out of the area, panic stopping hints, etc...) Most people don’t seem to be very alarmed by this relatively high possibility, and most I know are either nonchalant, or not even that. The truth is, we would have somewhere between 15 minutes and two hours notice, assuming Hawaii notifies us. Myself? I keep a knapsack ready, but it’s quite minimal. I’m not afraid.purple heart

Service Animals

I wrote about this some years ago, but a situation has refreshed it— and, for the record, I’ve researched all the ADA rules about service/ emotional support animals, and what I’m going to mention is not addressed. So, if anyone knows the answer, or has an opinion regarding the probability of it, please post!

There is no requirement compelling any business to allow emotional support animals, so that part of the question is solved. However, “Service” animals, with a few exceptions, as noted by the ADA, are to be accommodated. (ie— zoos and other animal menageries can firmly prohibit it because of the high possibility of predator-types becoming unstable). Here’s what I want to throw out there—a guy owns a sit-down deli/cafe. His two employees, who are always there, have certifiable issues with dogs—one is, let’s say, highly allergic, and the other has a medical-supported fear. Must he expect these employees to have to quit their jobs, because someone (covered by the ADA rule) might come in? Also, just wondering, what do YOU, my friends, think about this? And, just for the moment, assume that it has to be one way or another...don’t try to figure out a way to carry the animal, put powder on it, etc...assume that if the rule is enforced, the employees must be out of a job. So, here are two of my appetizer recipes (what I’m taking to the outing today)

Deviled Eggs— take eggs out of fridge night before. Just do it. Shake each individual egg lightly; this will “center” the yolk. Place in pan, do not crowd or stack. Cover with tepid (just barely Luke-warm) water. Bring to boil, count to 60, turn OFF burner. Cover and set timer for 13 minutes. When timer goes off, drain and cover eggs with cold water. Count to 60. Eggs will still be somewhat hot. You want that, as they peel much better. GENTLY tap egg until you get a good crackle going, but not enough to pierce the egg, of course. Gently peel, set aside, peel rest of batch. Use a butter knife, and cut egg long way, wiping knife with paper towel each egg or two. (Debris on knife makes the cut more difficult). Gently work yolk into mixing bowl. When all yolks are prepped, flake until fine, almost powdery. Add whatever spices you want, and finely minced onion. Add (get this) 1 teaspoon mayonnaise or miracle whip PER egg. Blend until creamy smooth. Garnish with olive, parsley, paprika. They are to die for. Hint: if packing to an event, take the whites and filling separate, and fill and garnish when you get there.

Turkey breast roll ups—Get about a pound of medium-sliced turkey breast (thin is too thin, thick won’t roll up well) mix I brick softened cream cheese- I use Neufchâtel, with i heaping tablespoon mayonnaise (don’t use miracle whip on this one, it will not work as well) spread entire slice, place dill or sweet pickle spear—small, in front-center, and roll up. Cut very ends, save in bowl for omelette filling next day or so, cut trimmed roll exactly in half. Should make 20 or so yummy appetizers. The natural Tryptophan in the turkey “marries” the mayo-cream cheese which is then “bloomed” by the pickle, whether sweet or dill. It’s all that I can do to not eat them before I get there!teddybear

Like, do you ever hear, “White male with genealogy papers and sterling, pedigree family tree dating back to Hadrian graduates from Norte Dame”. ? We are in such overkill about terminology...in the movie “Ghost”, Whoopi Goldberg’s character, and her sisters, refer to “A WHITE guy...”. So, it’s not just one side that “clarifies” a person’s race. “ Law &Order programs frequently refer to suspects, et al, as black, or Japanese, and so on. May I ask just one question, of anyone out there...what’s the beef? I mean, the REAL beef? If nothing negative is meant by a description, and so many cultures engage, why the constant kerfuffles over it? Why make a problem where there isn’t one?dunno

I believe some of us might step away from you, though your eclectic experience be patent and helpful. It’s the way you come across; scolding, appearing to one- up everything said. Surely your doctoral program outlined the importance of confluent, natural communication, generously sprinkled with a friendly and kind demeanor. I’m academic, and totally embrace it. However, humanity and people’s feelings take center stage to just “needing to be right”. You are twisting the wrench too tight, Doctor. Loosen the grip, and learn to heart the adage “You can catch more flies with honey than with vinegar”. Success with people is largely about YOU, and you can present your knowledge and research with acclaim if you are kind. And, it is frequently the only way some of us poor little lost lambs will hear. Be wise. I can’t believe you didn’t pick this up in university. It’s splattered all over the campuses.

It was unclear to me, also, just where the headline was going. However, I tried to follow...hope springs eternal, and that’s not just a theory!laugh look, in the midst of this oft miserable existence, we find humor and mirth, we name places “ Pleasant Valley”, “ Sunrise Lane”, “Morning Glory Beach”... ever faithful that Life is good, even in the very face of tragedy. Am I right?

I don’t know. So much of study is theory, at best. I mean, one could take the top twenty Harvard scholars and test them out, then write a report that states, “in a study group, the majority scored at 95%”, and many people reading that would think it valid...though it really isn’t fairly representative. I’m grateful to be amongst the living, and it IS because of modern medicine. I admit I don’t know, but I’m not dissing it either way. I don’t know, neither do many educated people. I don’t see where I inserted this...dunno What statistic are you specifically asking me for? My medical profile? I understand you seeing yourself as objective. It reminds me of a college paper I received back..though it was given an A-, it was marked all over with comments from the doctor/professor with, “Oh really? Who says”? And, “Too shallow. Academic investigation isn’t blasphemy. The Pope is believed by followers to be infallible. Yet this is contrary to scripture. (“There is none righteous, no, not one”.) in fact, the very existence of The Pope is in direct opposition to Christianity. By the same token, The United States being “ free” is anecdotal, at best. Much of what we do, and our laws and how they’re interpreted, are in direct opposition to what we said we wanted when developing America. We’ve become what we fled. Religions have become the very oxymorons of the intent and purpose. It is not blasphemy to call a spade a spade...and, get this, I AM a believer...it’s just that I see it as personal, unique, and unlike any others’. It’s different because it’s SUPPOSED to be different. There is not one butterfly. There are hundreds of species of butterflies.

Why do some faiths say their unexplainable beliefs are the real McCoy, but invalidate other faiths’ unbelievable beliefs? It’s spinning the “my fantasy is true...yours isn’t”. All the religions of the world have impossibilities, as we know them, anyway, in their doctrine. Who REALLY knows who is right?
